The sacred tetragrammaton Name of God:
A refined approach to the Hebrew term

Ex. 3:13-15 brings us to the passage that is of greatest concern for this study. What is God's name? What does the name mean or signify? What sort of question is Moses asking? Bearing in mind that v. 12 says "I will be with you," in v. 14 we have the same form of the verb hayah. Notice that we do not have in v. 14 ani asher ani but a paranomastic use of the verb hayah. This suggests on the one hand that we ought not to translate the phrase "I am that I am" as if it were an ontological statement, a statement about God's being, but rather we seem to be being told something about God's activity or self-revelation in his activity. The focus then is not on God's being a self-contained, self-existent being.

Normally when God was going to act or had just revealed himself, he was given a new title or name (cf. Gen. 16:13). Notice that Moses does not say "Who are you, or who shall I say that you are?" Rather, he asks what he should say when it is inquired: "What (mah) is his name?" which seems to mean "What new revelation have you received from God?" "Under what new title has God appeared to you?"

Moses' question is posed not merely as a hypothetical one, but as the natural and expected reaction of the oppressed Israelites. Authenticity of Moses' mission is linked to a revelation of the divine name confirming that God is going to do something. Notice that vv. 14b-15 do not suggest that eyeh asher eyeh is taken as a refusal by God to respond or to reveal himself. It cannot be a totally enigmatic response. Furthermore, vv. 14b-15 should be seen as parallel explanations or responses and v. 15 is clear enough. It is the God of their fathers who is speaking to them and promising this, and that God is already in part known to them.

The verbal form eyeh is an imperfect that indicates a kind of action, not primarily a time of action — in this case an action yet to be completed. Thus it is an action that could have begun in the past, or begins in the present or will begin in the future, but will take some time to be completed. In the case of v. 12 we know that the sense must be futuritive. This suggests we should see it the same way here.

It seems probable that the Tetragrammaton YHWH is a shortening of the whole phrase eyeh asher eyeh into a personal name. The clause contains the necessary vowels, and the consonants are quite close. Clearly eyeh is given as a form of God's name in v. 14b. To be sure, this is a punning on the name, a play on words, but it does reveal something about the name. God then is not speaking about what God is in the divine essence, but rather what Yahweh is or will be in relationship to his people — in his self-revelation. This comports nicely with the fact that the Israelites' reason for asking about the name has to do with a great need. They need to know not merely that God exists, but that God does and will soon act on their behalf. S. Driver notes:
The expression I will be is a historical formula; it refers, not to what God will be in Himself; it is no predication regarding his essential nature, but one regarding what He will approve Himself to others, regarding what he will show Himself to be to those in covenant with Him, as by His providential guidance of His people, and the teaching of His prophets, His character and attributes were more and more fully unfolded to them.
The formula thus means: I will be understood by my future acts and revelation. This makes very good sense indeed, for in all the subsequent accounts of Israelite history God is to be known as the one who brought Israel out of Egypt (Ex. 20:2). "The revelation of the name therefore is not merely a deep theological truth; it is a call to a response of faith by Moses and by Israel."

This means that Israel's God is a God of history, not a God who created and wound up the universe like a clock and then left it to wind down on its own. Yahweh is the one who keeps intervening in human history. Thus this naming is in fact a call for Moses to have faith. As in v. 12 so in v. 14 God is saying to Moses and so to Israel, "I will reveal myself through these future acts of redemption and you will know me by them, as the God who delivers you out of Egypt." In short, it is true even of God that you shall know the tree by the fruit it bears.



Τα εδ. Έξ 3:13-15 μας φέρνουν στο κείμενο που είναι μεγίστου ενδιαφέροντος για αυτή τη μελέτη. Αυτό υποδηλώνει από τη μία πλευρά ότι δεν πρέπει να μεταφραστεί η φράση «Είμαι αυτό που Είμαι» σαν να επρόκειτο για οντολογική δήλωση, μια δήλωση για την οντότητα του Θεού, αλλά μάλλον φαίνεται ότι λέγεται κάτι σχετικά με τη δραστηριότητα του Θεού ή την αυτοαποκάλυψη του Θεού μέσω της δραστηριότητάς του. Δεν εστιάζει συνεπώς στην ύπαρξη του Θεού ως αυτάρκους, αυθύπαρκτου όντος.

Συνήθως όταν ο Θεός επρόκειτο να ενεργήσει ή είχε μόλις αποκαλύψει τον εαυτό του, λάμβανε ένα νέο τίτλο ή όνομα. (παραβ. Γε 16:13) Είναι αξιοσημείωτο ότι ο Μωυσής δεν λέει «Ποιος είσαι εσύ ή ποιος να πω ότι είσαι;» Μάλλον, ρωτάει τι πρέπει να τους πει όταν ζητηθεί να μάθουν: «Ποιο (Εβρ. μαχ ["τι"]) είναι το όνομά του;» το οποίο προφανώς σημαίνει «Ποια νέα αποκάλυψη έλαβες από τον Θεό;» «Με ποιο νέο τίτλο εμφανίστηκε ο Θεός σε εσένα;»

Η ερώτηση του Μωυσή δεν τίθεται απλώς ως υποθετική αλλά ως μια φυσική και αναμενόμενη αντίδραση των καταπιεσμένων Ισραηλιτών. Η αυθεντικότητα της αποστολής του Μωυσή συνδέεται με μια αποκάλυψη του θεϊκού ονόματος που επιβεβαιώνει ότι ο Θεός πρόκειται να κάνει κάτι. Είναι αξιοσημείωτο ότι τα εδ. 14β-15 δεν υποδηλώνουν ότι η φράση εγιέχ ασέρ εγιέχ εκλαμβάνεται ως άρνηση εκ μέρους του Θεού να αποκριθεί ή να αποκαλύψει τον εαυτό του. Η ρηματική μορφή εγιέχ είναι μη τετελεσμένη η οποία υποδηλώνει  κάποιου είδους ενέργεια, όχι κυρίως το χρόνο της ενέργειας —σε αυτή την περίπτωση μια ενέργεια που αναμένεται να ολοκληρωθεί. Έτσι, πρόκειται για μια ενέργεια που μπορεί να ξεκίνησε στο παρελθόν ή να ξεκινά στο παρόν ή θα ξεκινήσει στο μέλλον, αλλά η οποία θα χρειαστεί κάποιο χρονικό διάστημα για να ολοκληρωθεί. Στην περίπτωση του εδ. 12 γνωρίζουμε ότι η έννοια πρέπει να είναι στον μέλλοντα. Αυτό υποδηλώνει ότι πρέπει παρόμοια να το δούμε και εδώ.

Φαίνεται πιθανότερο ότι το Τετραγράμματο ΙΧΒΧ αποτελεί σύντμηση σε προσωπικό όνομα της πλήρους φράσης εγιέχ ασέρ εγιέχ. Η πρόταση περιέχει τα απαραίτητα φωνήεντα και τα σύμφωνα πλησιάζουν αρκετά. Ξεκάθαρα το εγιέχ δίνεται ως μορφή του ονόματος του Θεού στο εδ. 14β. Το βέβαιο είναι ότι πρόκειται για λογοπαίγνιο με το όνομα, το οποίο όμως αποκαλύπτει όντως κάτι σχετικά με το όνομα. Ο Θεός συνεπώς δεν μιλάει σχετικά με το τι είναι ο Θεός κατά τη θεϊκή υπόσταση αλλά μάλλον τι είναι ή τι θα είναι ο Ιαβέ σε σχέση με το λαό του — κατά την αυτοαποκάλυψή του. Αυτό ταιριάζει θαυμάσια με το γεγονός ότι ο λόγος για τον οποίο οι Ισραηλίτες ρώτησαν σχετικά με το όνομα σχετιζόταν με το ότι υπήρχε μια μεγάλη ανάγκη. Είχαν ανάγκη να γνωρίζουν όχι μόνο ότι ο Θεός υπάρχει αλλά ότι ο Θεός πράττει και ότι σύντομα θα ενεργήσει για χάρη τους. Ο S. Driver σημειώνει:

Η έκφραση Εγώ θα είμαι αποτελεί μια ιστορική διατύπωση· αναφέρεται όχι στο τι θα είναι ο Θεός ως προς τον εαυτό του· δεν αποτελεί κατηγόρηση αναφορικά με την υποστατική φύση του, αλλά αναφορικά με το τι Εκείνος θα αποδειχτεί ότι είναι προς τους άλλους, αναφορικά με το τι θα δείξει Εκείνος ότι είναι προς εκείνους που είναι σε διαθήκη μαζί Του, όπως μέσω της προνοιακής κατεύθυνσής Του προς το λαό Του και της διδασκαλίας των προφητών Του, ο χαρακτήρας Του και οι ιδιότητές Του ξεδιπλώνονταν όλο και περισσότερο προς αυτούς.
Η διατύπωση, συνεπώς, σημαίνει: Θα γίνω αντιληπτός μέσω των μελοντικών πράξεών μου και της αποκάλυψής μου. Αυτό είναι πράγματι το σωστό συμπέρασμα διότι σε όλες τις επακόλουθες αφηγήσεις της ισραηλιτικής ιστορίας ο Θεός επρόκειτο να γίνει γνωστός ως εκείνος που έβγαλε τον Ισραήλ από την Αίγυπτο. Αυτό σημαίνει ότι ο Θεός του Ισραήλ είναι ο Θεός της ιστορίας, όχι ο Θεός που δημιούργησε και ρύθμισε το σύμπαν σαν ένα ρολόι και κατόπιν το άφησε μόνο του για να λειτουργήσει. Ο Ιαβέ είναι εκείνος που εξακολουθεί να επεμβαίνει στην ανθρώπινη ιστορία. Συνεπώς αυτή η ονομάτιση είναι στην πραγματικότητα ένα κάλεσμα για τον Μωυσή ώστε να έχει πίστη. Όπως στο εδ. 12 έτσι και στο εδ. 14 ο Θεός λέει στον Μωυσή και επίσης στον Ισραήλ: «Θα αποκαλύψω τον εαυτό μου μέσω αυτών των μελλοντικών πράξεων απολύτρωσης και θα με γνωρίσετε μέσω αυτών, ως τον Θεό που σας ελευθέρωσε από την Αίγυπτο». Εν ολίγοις, ισχύει ακόμη και για τον Θεό ότι θα γνωρίσετε το δέντρο από τους καρπούς που κάνει.

Propaganda and Ideology of the Fourth of August Regime
in the Context of Hitler's New European Order

On certain occasions, the propaganda used by the regime aped the methods of Mussolini and Hitler. Metaxas gave himself symbolic titles, such as 'First Worker' (Protos Ergatis) and 'First Peasant' (Protos Agrotis), founded the national youth organisation EON (Ethniki Organosis Neoleas) which resembled the Hitler Youth, and introduced the 'Roman salute'. However, observers inside and outside Greece agreed that Metaxas failed to generate genuinely popular support.

Moreover, these were not symbols of unity rooted in an original mass movement, and Metaxas's road to power was very different from both Hitler's and Mussolini's. The fact that the regime was not based on a mass movement indicates that it would be wrong to call the dictatorship 'fascist'. Moreover, the regime did not have any plans for territorial expansion: these had been buried in the wake of Greece's disastrous campaign in Asia Minor in 1920-22.

However, all such observations on the Metaxas dictatorship pertain to a regime in its early infancy. The fact that Metaxas obviously intended the regime to be a permanent one makes it necessary also to evaluate the institutions and symbols which Metaxas created in regard to their potential significance and meaning in a long-term context. Seen from this point of view, Metaxas was clearly attempting to transform the Greek mind, and create a generation of new and regenerated Greeks. These efforts were in line with the ones undertaken by Hitler, Mussolini and Stalin to create a 'new man'. The ideological content of Metaxas's reforms, however, had much in common with Fascism and Nazism, and can be seen as an attempt to reorient Greece in a direction which would also make it conform with the planned Axis 'New Order' in Europe.

The fight against communism was the area in which the shared ideological interests of the two regimes were most significant and successful for both parties. The oppression of political opponents, and in particular of the Communists, during the Metaxas regime was, in terms of determination and efficiency, without precedent in Greek history. In November 1936, on the initiative of the Gestapo and as the result of an inquiry from the German legation in Athens, Metaxas declared that he approved the Greek Security Police and the Gestapo joining forces to exchange information as a defence against 'Bolshevik agitation'. According to a German assessment, it was because of Metaxas that only a year after the establishment of his regime, communism lost its most important stronghold in the Near East. At the end of 1937, the British legation acquired an item of correspondence dated May the same year between Heinrich Himmler, head of the SS, and Konstandinos Maniadakis, the Secretary of Security. This stated that Maniadakis accepted an invitation on behalf of the Greek police to participate in a congress about methods to fight communism. In this way German assistance also played a part in Metaxas's fight against internal enemies. It is notable that the British Foreign Office learned from sources in Germany that ten per cent of the value of the German arms trade to Greece went to Metaxas. The money was used for the establishment of Metaxas's party machinery and propaganda for the regime. The British legation in Athens did not doubt the validity of the information, and in their eyes the crucial question was whether Metaxas would finally manage to claim supremacy and thrust the King into the background.

During the initial phase of the dictatorship, Metaxas made it clear to the public that he did not hold anti-Semitic views. According to Kordt, this reverberated in the censored Greek press, which stressed that the Jews in Greece had the same status as any other citizen, and that anyone in Greece who entertained anti-Semitic feelings was a bad Greek. This stance was also noticed abroad. The Jewish Chronicle in London printed a short article in September 1937 which praised Metaxas for prohibiting the publishing of anti-Semitic writings. However, this public image contradicts the impression Goebbels gained from his talks with Metaxas in September 1936, which prompted him to characterise Metaxas as 'strongly anti-Semitic'. This conversation, of course, was private, and Metaxas might have attempted to please Goebbels by expressing such views. Nevertheless, it indicates that Metaxas found it opportune to convey the impression to Berlin that he held anti-Semitic views. The regime also made some groundwork in institutionalising overt and state-sponsored anti-Semitism, as well as uritermerischen ideology. Application for membership of the EON, established with an eye to creating a new stock of regenerated Greeks, required the individual to be a Greek Christian. No Jews, Muslims or other minorities were permitted. At its peak, the EON had more than one million members. The frequent, and massive, book-burnings organised by the state included works by personalities whom Nazi anti-Semites systematically identified as exponents of international Judaism, namely Stefan Zweig and Sigmund Freud.

Whether or not this state-sponsored anti-Semitism arose from heart-felt convictions, we should note that it does provide some evidence that Metaxas's Greece was a seriously race-conscious state that would form part of a future Axis-dominated New European Order. Moreover, in general the regime placed much emphasis on creating a national identity based on cultural and ethnic homogeneity. To this end, Turkish-speaking Muslims, Slavophones and Albanian-speaking minorities were forced to compromise their beliefs, and instruction of Greek became mandatory in minority schools. The regime also clamped down on the subculture of the refugees from Asia Minor, in regard to certain manifestations of their specific identity. This, in particular, found an expression in the rembetika tradition: certain songs were prohibited, while the police closed down clubs and even imprisoned performers on the grounds that they were politically or morally subversive.

The regime wanted to create a modern, and culturally heterogeneous, Greece in the image of classical Hellas and Byzantium, and introduced a cultural and national policy of integration. Metaxas ascribed paramount symbolic significance to a militaristic and oligarchic Sparta, and depicted Sparta as the first of three Greek civilisations. The two others were Byzantium, representing the Christian Orthodox ideal, and Metaxas's own regime, portrayed as 'the Third Greek Civilisation'. Metaxas believed that after 400 years of Turkish domination, Greek civilisation was totally obliterated, and he saw the ideal of classical Greece as a means to elevate twentieth-century Greece from its present level, as a 'bastard culture' of idle individuals, into a 'pure race' of disciplined and uncorrupted men and women working for the common cause of creating a 'new Greece'. It is notable that Metaxas did not see classical Greece merely as an ideal to be passively admired, but rather as a method for political action to modernise society and culture. This conception of Hellas probably stemmed from his admiration for German culture. His views to some extent resembled whose of Wilhelm von Humboldt, the architect of the German restoration after the Napoleonic Wars, who authorised the instruction of the classical Greek language and culture as a means of purging German culture and society from French influence and raising Germany to a higher level of civilisation. If one believed that the extraordinary achievements of modern Germany were the results of the Humboldtian reformation, then the high level of German culture and society would appear to be the result of the implementation of the ideals of ancient Greece. Or, to put it differently, of a process in which Germans were to become transformed into ancient Greeks; this is, perhaps, the key to understanding Metaxas's deep admiration for German culture.

German admiration for Greek antiquity and the Humboldtian credo, in turn, gave Greek-German relations an emotional quality, which did not exist in German relations with other countries in the region, but which was somewhat similar to the sentiments the National Socialists nurtured for the Nordic countries out of racial attachment to its peoples, whom they believed to be of an especially pure Aryan stock. According to the British minister to Greece, Sir Sidney Waterlow, the National Socialists saw an intellectual affinity between the ancient Greeks and the modern Germans, or, as he expressed it, between Perides and Hitler. Albert Speer noted that Hitler was primarily influenced by Greek architecture, and regarded Greek culture as an expression of the highest imaginable perfection. From the diaries of Goebbels it is possible to discern the feelings that were aroused in the German Minister of Propaganda during his first visit to Greece. In the following notes he describes how the dream of his youth came true in the airspace above Mount Olympus: 'There towers Mount Olympus and there Parnassus. It makes one warm. Old memories from my youth emerge. A dream comes true. The sun sets beautifully. Over eternal Greece'." On the second clay of his visit, Goebbels went to the Acropolis. The minister described it as the happiest morning of his life: 'Yesterday: one of the most beautiful and most significant mornings of my life. On the Acropolis. Only a few people. And I wandered about for hours in these noble places of Nordic art.'

It is interesting that Goebbels depicts Greek antiquity as a part of the pre-Christian Nordic world, a fact that reveals that he subscribed to the views of racial 'history' propagated by people like Guido von List, who believed that the Aryans originally stemmed form the North Pole but had spread to the Mediterranean and bred the race of the ancient Greeks." It was in this spirit that Goebbels wrote: 'My soul is filled with beauty. Blessed antiquity, which lived in eternal joy free from Christianity. An evening stroll through the town. This joyful highest life. This smell of happiness. How pleased the Fuehrer would be if he were here with us!' His joy at seeing the Acropolis again in 1939 inspired Goebbels further: 'On Acropolis. O, this shattering view! The cradle of Aryan culture.'

Johannine Comma again /

One contribution of 1 John to the theology of the church which we have nowhere discussed is the so-called Johannine 'Comma', the words familiar to readers of the Authorised Version at 1 John 5:7-8, 'Because there are three that bear record in heaven, the Father, the Word and the Holy Ghost: and these three are one. And three that bear witness in earth, the spirit, and the water, and the blood: and these three agree in one'. The presence of so explicit a trinitarian witness within the New Testament would be both surprising and important. However, despite having been enthusiastically defended in the past, more because of their dogmatic than their text-critical importance, it is evident that these words were not penned by the author of 1 John but came into the text as a gloss, invited by the theme of three in unity. Only a few, very late, Greek manuscripts contain them, and the evidence suggests that they originated in the third century within the Latin tradition, only really entered the tradition of Greek New Testament editions in the sixteenth century, and had a colourful and contentious history thereafter.

Η εξέλιξη
της σύγχρονης βιβλικής ερμηνευτικής /

The development
of contemporary Biblical hermeneutics



Αποτελεί ιδιαίτερο χαρακτηριστικό της τελευταίας εκατονταετίας η μεγάλη άνθηση της βιβλικής ερμηνευτικής, η ανάπτυξη νέων ερμηνευτικών μεθόδων αλλά και περισσότερο ολιστικών αναλύσεων του βιβλικού κειμένου και γενικότερα η στροφή των ερμηνευτών σε ζητήματα μεθοδολογίας ή ιστορίας της έρευνας. Συστηματοποιώντας αυτήν την πορεία εξέλιξης, η οποία ξεκινά με την εμφάνιση της λεγόμενης ιστορικοκριτικής μεθόδου, θα μπορούσαμε να παρατηρήσουμε μία τριμερή διάκριση σε ερμηνευτικές προσεγγίσεις ή μεθόδους που εστιάζουν το ερευνητικό τους ενδιαφέρον α) στο συγγραφέα και στην ιστορία του κειμένου, β) στο ίδιο το κείμενο ως τελικό αποτέλεσμα και γ) στον αναγνώστη -χθες και σήμερα- του κειμένου. Στην πρώτη κατηγορία υπάγονται οι κλασικές πλέον «ιστορικοκριτικές» ερμηνευτικές προσεγγίσεις: η μορφοϊστορική (Formgeschichte), η ιστορία των πηγών (Quellenkritik), η ιστορία της σύνταξης των κειμένων (Redaktionsgeschichte) αλλά και η περισσότερο σύγχρονη κοινωνιολογική ερμηνευτική προσέγγιση. H καθεμιά από αυτές ξεκινώντας από τις δικές της προϋποθέσεις και αξιοποιώντας με διαφορετικό τρόπο μεθοδολογικά εργαλεία της φιλολογικής και ιστορικής επιστήμης αποπειράται να αναπαραστήσει την πορεία σύνθεσης του βιβλικού κειμένου και του ιδιαίτερου ιστορικοκοινωνικού πλαισίου (Sitz im Leben) μέσα στο οποίο αναπτύχθηκαν αρχικά οι προφορικές βιβλικές παραδόσεις και στη συνέχεια αυτές συγκεντρώθηκαν και αποτυπώθηκαν μέσα στο γραπτό βιβλικό κείμενο. Η δεύτερη κατηγορία περιλαμβάνει εκείνες τις προσεγγίσεις που εξετάζουν ζητήματα τα οποία σχετίζονται άμεσα με το κείμενο ως τελικό αποτέλεσμα και ως ολοκληρωμένη ενότητα με τις ιδιαίτερες αφηγηματικές δομές του, με συγκεκριμένο θεολογικό στόχο και ως οργανικό τμήμα μίας ευρύτερης κειμενικής παράδοσης ή του κανόνα της Αγίας Γραφής. Ανάμεσά τους συγκαταλέγονται η ρητορική κριτική, η αφηγηματική κριτική, η λεγόμενη «κανονική» ερμηνευτική προσέγγιση και δομικές ή μεταδομικές αναλύσεις του κειμένου. Οι ερμηνευτικές προσεγγίσεις της τρίτης κατηγορίας στρέφουν το ενδιαφέρον τους στον αναγνώστη και στον τρόπο που αυτός κατανόησε και κατανοεί το κείμενο: η λεγόμενη μέθοδος της ανταπόκρισης του αναγνώστη, η ιστορία της πρόσληψης του βιβλικού κειμένου, η φεμινιστική προσέγγιση, η μεταποικιακή ερμηνευτική προσέγγιση, η οικολογική ερμηνευτική προσέγγιση,  η  ερμηνεία της απελευθέρωσης κ.ά. Εξετάζοντας τη θεαματική αυτή ανάπτυξη των σύγχρονων ερμηνευτικών τάσεων στη μέχρι τώρα πορεία της παρατηρούμε μία διπλή μετατόπιση του ερμηνευτικού ενδιαφέροντος: α) από τις λεγόμενες διαχρονικές στις λεγόμενες συγχρονικές προσεγγίσεις του κειμένου και β) από το νεωτερικό στο λεγόμενο μετανεωτερικό τρόπο αντίληψης του κειμένου. Αυτή η αλλαγή του ερευνητικού προσανατολισμού οδήγησε στη μετάβαση από το καθαρά ιστορικό πλαίσιο του κειμένου στον ίδιο τον κόσμο του κειμένου (ή όπως συχνά λέγεται επιγραμματικά από το κείμενο στον αναγνώστη). Αναλύοντας κάποιες από αυτές τις σύγχρονες ερμηνευτικές προσεγγίσεις ο ομότιμος καθηγητής της Κ.Δ. Ι. Καραβιδόπουλος σε μία παλαιότερη εισήγησή του επεσήμανε τη στενή σχέση που υπάρχει μεταξύ αυτών των τάσεων και των σύγχρονων με αυτές φιλοσοφικών ιδεών και φιλολογικών πρακτικών. Αναπτύσσοντας λίγο ακόμη αυτήν τη διαπίστωση του καθηγητή θα θέλαμε να επισημάνουμε και την προσπάθεια όλων αυτών των ερμηνευτικών προσεγγίσεων της εποχής μας να καταστεί ο βιβλικός λόγος επίκαιρος και να συνδιαλεχθεί η βιβλική θεολογική έρευνα δημιουργικά με το σύγχρονο κοινωνικό γίγνεσθαι.

But after the punishment of this impious murderer, a new commandment was enacted, which had never before been thought worthy of being reduced to writing; but unexpected innovations cause new laws to be devised for the repression of their evils. At all events, the following law was immediately introduced: “Whoever curses God shall be guilty of sin, and whoever names the name of the Lord shall die.” [Leviticus 24:15, 16] Well done, O all-wise man! You alone have drunk of the cup of unalloyed wisdom. You have seen that it was worse to name God than even to curse him; for you would never have treated lightly a man who had committed the heaviest of all impieties, and inflicted the heaviest punishment possible on those who committed the slightest faults; but you fixed death, which is the very greatest punishment imaginable, as the penalty for the man who appeared to have committed the heaviest crime. But, as it seems, he is not now speaking of that God who was the first being who had any existence, and the Father of the universe, but of those who are accounted gods in the different cities; and they are falsely called gods, being only made by the arts of painters and sculptors, for the whole inhabited world is full of statues and images, and erections of that kind, of whom it is necessary however to abstain from speaking ill, in order that no one of the disciples of Moses may ever become accustomed at all to treat the appellation of God with disrespect; for that name is always most deserving to obtain the victory, and is especially worthy of love. But if any one were, I will not say to blaspheme against the Lord of gods and men, but were even to dare to utter his name unseasonably, he must endure the punishment of death.

European Court of Human Rights affirms the right to
conscientious objection to military service

Joint statement of Amnesty International, Conscience & Peace Tax International, International Commission of Jurists, Quaker United Nations Office, Geneva, and War Resisters' International

The Grand Chamber of the European Court of Human Rights, in a ground-breaking judgment (issued on Thursday) in the case of Bayatyan v. Armenia (Application no. 23459/03, 1/6/2011), has ruled that states have a duty to respect individuals’ right to conscientious objection to military service as part of their obligation to respect the right to freedom of thought, conscience and religion set out in Article 9 of the European Convention on Human Rights. In the light of this judgment, the above-named organizations call on Turkey and Azerbaijan, the only two parties to the Convention who do not yet provide for conscientious objection to military service, to take immediate steps to do so. Moreover, Armenia should amend its Alternative Service Act to ensure that it provides a genuine alternative service of a clearly civilian nature, which should be neither deterrent nor punitive in character, in line with European and international standards.

This is the first time that the right of conscientious objection to military service has been explicitly recognised under the European Convention on Human Rights.

The above-named organisations welcome this judgment in which the European Court of Human Rights has interpreted this right in line with the long-standing interpretation of the equivalent provisions of the International Covenant on Civil and Political Rights by the UN Human Rights Committee, the body set up under that treaty to monitor states parties’ compliance with its provisions.

The Bayatyan v Armenia case concerned a Jehovah's Witness who was sentenced to two and a half years in prison following his refusal of military service on the grounds of conscientious objection. Amnesty International, Conscience & Peace Tax International, International Commission of Jurists, Quaker UN Office and War Resisters' International submitted a joint third party intervention (http://quno.org/humanrights/CO/coLinks.htm#QUNOPUB) to the Grand Chamber which highlighted the UN Human Rights Committee's long-standing position that conscientious objection to military service is protected under the right to freedom of thought, conscience and religion. The organizations also highlighted recommendations of the Parliamentary Assembly and Committee of Ministers of the Council of Europe and provided the Court with information about the recognition of the right to conscientious objection to military service in the 47 member states of the Council of Europe.

Background
The case concerned Armenian conscientious objector Vahan Bahatyan, born in 1983, who lives in Yerevan, Armenia. He is a Jehovah's Witness who for reasons of conscience refused to perform military service. In 2001 he was sentenced to a prison term of one and a half years. His sentence was increased by one year after the Prosecutor appealed for a harsher sentence, claiming that his conscientious objection was “unfounded and dangerous”. When this decision was confirmed by the Armenian Supreme Court, Bayatyan took his case to the European Court.

On accession to the Council of Europe in 2000, Armenia committed itself “to adopt, within three years of accession, a law on alternative service in compliance with European standards and, in the meantime, to pardon all conscientious objectors sentenced to prison terms or service in disciplinary battalions, allowing them instead to choose, when the law on alternative service has come into force, to perform non-armed military service or alternative civilian service”1. The Alternative Service Act of 17 December 2003 made provision for conscientious objectors to military service including the creation of an "Alternative Civilian Service". At no time was Bayatyan given the option of performing this service; moreover those Jehovah's Witnesses who did embark on the service found that it was not clearly civilian in nature and included requirements such as the swearing of a military oath and the wearing of military uniforms that were unacceptable to them. More than 80 Jehovah's Witnesses have been imprisoned in the last four years for refusing this "alternative civilian service", which in its nature, in its duration (42 months, the longest stipulated anywhere in the world, and one-and-three-quarter times that of military service) and in its close supervision by the military authorities, is clearly not in accordance with European and international standards.

This judgment by the 17-person Grand Chamber of the European Court is the result of its review of an October 2009 judgment in the case by a seven-person Chamber which ruled that Article 9 of the European Convention on Human Rights did not protect conscientious objection to military service.

Article 9 of the European Convention on Human Rights and Article 18 of the International Covenant on Civil and Political Rights (ICCPR) contain almost identical provisions on the right to freedom of thought, conscience and religion. All states which are party to the European Convention are also party to the ICCPR. Since 1993, the UN Human Rights Committee, the body of independent experts established under the ICCPR to monitor states’ compliance with its provisions, has interpreted this as including the right to conscientious objection to military service. This is the first case where the European Court has ruled on this issue. Earlier European Court cases, such as Ulke v Turkey2, where the repeated imprisonment and other penalties imposed on a conscientious objector for the refusal of military service were found to constitute inhuman or degrading treatment, had not addressed conscientious objection to military service as such.

Επιπλέον, η Αρμενία πρέπει να τροποποιήσει την Νομοθετική Πράξη για την Εναλλακτική Υπηρεσία, ούτως ώστε να διασφαλίσει την παροχή γνήσιας εναλλακτικής υπηρεσίας καθαρά πολιτικής φύσης, η οποία δεν πρέπει να έχει ούτε αποτρεπτικό ούτε τιμωρητικό χαρακτήρα, σε εναρμόνιση με τα ευρωπαϊκά και διεθνή πρότυπα.

Είναι η πρώτη φορά που αναγνωρίζεται ρητά το δικαίωμα της αντίρρησης συνείδησης στη στρατιωτική θητεία υπό την Ευρωπαϊκή Σύμβαση για τα Ανθρώπινα Δικαιώματα.

Οι προαναφερθείσες οργανώσεις καλωσορίζουν την απόφαση αυτή, στην οποία το Ευρωπαϊκό Δικαστήριο Δικαιωμάτων του Ανθρώπου ερμήνευσε αυτό το δικαίωμα σε συμφωνία με την επί μακρόν ερμηνεία των αντίστοιχων διατάξεων του Διεθνούς Συμφώνου για τα Ατομικά και Πολιτικά Δικαιώματα της Επιτροπής Ανθρωπίνων Δικαιωμάτων των Ηνωμένων Εθνών, του φορέα που συστάθηκε βάσει αυτής της συνθήκης για να παρακολουθεί τη συμμόρφωση των κρατών μερών με τις διατάξεις της.

Οι οργανώσεις τόνισαν επίσης τις συστάσεις της Κοινοβουλευτικής Συνέλευσης και της Επιτροπής Υπουργών του Συμβουλίου της Ευρώπης και παρείχαν πληροφορίες στο Δικαστήριο όσον αφορά την αναγνώριση του δικαιώματος στην αντίρρηση συνείδησης στη στρατιωτική υπηρεσία στα 47 κράτη μέλη του Συμβουλίου της Ευρώπης (http://quno.org/humanrights/CO/coLinks.htm#QUNOPUB).

Υπόβαθρο
Η υπόθεση αφορούσε τον Αρμένιο αντιρρησία συνείδησης Vahan Bahatyan, γεννηθέντα το 1983, ο οποίος ζει στο Ερεβάν της Αρμενίας. Πρόκειται για Μάρτυρα του Ιεχωβά που αρνήθηκε για λόγους συνείδησης εκτελέσει τη στρατιωτική του υπηρεσία. Το 2001 καταδικάστηκε σε ποινή φυλάκισης 1,5 έτους. Η ποινή του αυξήθηκε κατά ένα χρόνο, μετά από έφεση που ασκήθηκε από τον Εισαγγελέα για σκληρότερη ποινή, ισχυριζόμενος ότι η αντίρρηση συνείδησης την οποία επικαλέστηκε, ήταν «αβάσιμη και επικίνδυνη». Όταν το Ανώτατο Δικαστήριο της Αρμενίας επικύρωσε την απόφαση αυτή, ο Bayatyan προσέφυγε στο Ευρωπαϊκό Δικαστήριο για την υπόθεσή του.

Με την προσχώρησή της στο Συμβούλιο της Ευρώπης, το 2000, η Αρμενία δεσμεύτηκε «να υιοθετήσει, εντός τριών ετών από την προσχώρηση, νόμο περί εναλλακτικής υπηρεσίας σύμφωνο με τα ευρωπαϊκά πρότυπα και, στο μεταξύ, να αποδώσει χάρη σε όλους τους αντιρρησίες συνείδησης που καταδικάστηκαν σε ποινές φυλάκισης ή υπηρεσίας σε πειθαρχικά τάγματα, επιτρέποντάς τους να επιλέξουν αντί αυτών -όταν ο νόμος περί εναλλακτικής υπηρεσίας τεθεί σε ισχύ- να εκπληρώσουν είτε άοπλη στρατιωτική υπηρεσία είτε εναλλακτική πολιτική υπηρεσία».1 Η Νομοθετική Πράξη για την Εναλλακτική Υπηρεσία της 17ης Δεκεμβρίου 2003 προέβλεψε διάταξη για τους αντιρρησίες συνείδησης στη στρατιωτική υπηρεσία, συμπεριλαμβανομένης της δημιουργίας μίας «Εναλλακτικής Πολιτικής Υπηρεσίας». Ουδέποτε δόθηκε στον Bayatyan η επιλογή να εκπληρώσει αυτή την υπηρεσία· επιπλέον, όσοι Μάρτυρες του Ιεχωβά εκπλήρωσαν αυτή την υπηρεσία, διαπίστωσαν ότι δεν ήταν καθαρά πολιτικής φύσης, και περιελάμβανε απαιτήσεις όπως το να ορκίζονται με στρατιωτικό όρκο και να φορούν στρατιωτική ενδυμασία, τα οποία δεν είναι αποδεκτά από αυτούς. Περισσότεροι από 80 Μάρτυρες του Ιεχωβά έχουν φυλακιστεί τα τελευταία τέσσερα χρόνια λόγω της άρνησής τους να υπηρετήσουν αυτήν την «εναλλακτική πολιτική υπηρεσία», η οποία ξεκάθαρα δεν συμφωνεί με τα ευρωπαϊκά και διεθνή πρότυπα, εξαιτίας της φύσης της, της διάρκειάς της (42 μήνες, η μεγαλύτερη που ορίζεται από κράτος στον κόσμο, και 1 και 3/4 μεγαλύτερη από τη διάρκεια της στρατιωτικής θητείας) και της στενής της εποπτείας από τις στρατιωτικές αρχές.

Αυτή η απόφαση του 17μελούς Τμήματος Μείζονος Σύνθεσης του Ευρωπαϊκού Δικαστηρίου είναι αποτέλεσμα της επανεξέτασης μιας απόφασης του Οκτωβρίου 2009 για την υπόθεση αυτή, από ένα 7μελές Τμήμα το οποίο αποφάνθηκε ότι το Άρθρο 9 της Ευρωπαϊκής Σύμβασης για τα Ανθρώπινα Δικαιώματα δεν προστάτευε την αντίρρηση συνείδησης στη στρατιωτική θητεία.

Το Άρθρο 9 της Ευρωπαϊκής Σύμβασης για τα Δικαιώματα του Ανρθώπου και το Άρθρο 18 του Διεθνούς Συμφώνου για τα Ατομικά και Πολιτικά Δικαιώματα περιέχουν σχεδόν ταυτόσημες διατάξεις για το δικαίωμα στην ελευθερία της σκέψης, της συνείδησης και της θρησκείας. Όλα τα κράτη που είναι μέρη της Ευρωπαϊκής Σύμβασης είναι επίσης μέρη του Διεθνούς Συμφώνου για τα Ατομικά και Πολιτικά Δικαιώματα. Από το 1993, η Επιτροπή Ανθρωπίνων Δικαιωμάτων των Ηνωμένων Εθνών, το σώμα ανεξάρτητων εμπειρογνωμόνων που συστάθηκε από το Διεθνές Σύμφωνο για τα Ατομικά και Πολιτικά Δικαιώματα για να παρακολουθεί τη συμμόρφωση των κρατών με τις διατάξεις του, το έχει ερμηνεύσει ότι περιλαμβάνει το δικαίωμα της αντίρρησης συνείδησης στη στρατιωτική υπηρεσία. Αυτή είναι η πρώτη υπόθεση όπου το Ευρωπαϊκό Δικαστήριο έλαβε απόφαση επί του θέματος. Σε προηγούμενες υποθέσεις του Ευρωπαϊκού Δικαστηρίου -όπως η υπόθεση Ulke κατά Τουρκίας2, όπου κρίθηκε ότι οι επαναλαμβανόμενες φυλακίσεις και άλλες ποινές που επιβλήθηκαν σε αντιρρησία συνείδησης για την άρνησή του να υπηρετήσει στρατιωτική θητεία αποτελούν απάνθρωπη ή ταπεινωτική μεταχείριση- δεν είχε εξεταστεί αυτή καθεαυτή η αντίρρηση συνείδησης στη στρατιωτική υπηρεσία.

STRASBOURG, France—On July 7, the Grand Chamber of the European Court of Human Rights (ECHR) concluded by an overwhelming majority of sixteen votes to one that Armenia violated the right of freedom of conscience of Mr. Vahan Bayatyan, one of Jehovah’s Witnesses in Armenia convicted and imprisoned for his conscientious objection to military service. The ruling marks a defining point in the protection of the rights of conscientious objectors since it reverses the 44-year case law on this issue.

In 2002, Mr. Bayatyan was sentenced to two and a half years’ imprisonment by the Armenian authorities for his refusal to bear arms, a personal decision motivated by his Bible-trained conscience. Armenia’s punitive actions toward Mr. Bayatyan took place despite its previous commitment to the Council of Europe on its accession in January 2001 to institute a genuine civilian alternative service for conscientious objectors and, in the meantime, to pardon all those who had been convicted. Mr. Bayatyan appealed his case to the ECHR, stating that his conviction violated his rights under Article 9 of the European Convention on Human Rights (“the Convention”). Although a chamber of the Court ruled against Mr. Bayatyan in 2009, the Grand Chamber reversed this decision by holding that “. . .the applicant’s conviction constituted an interference which was not necessary in a democratic society within the meaning of Article 9 of the Convention. Accordingly, there has been a violation of that provision.” The Grand Chamber explained that Article 9 protects “a religious group whose beliefs include the conviction that service, even unarmed, within the military is to be opposed.”

This is the first time in the history of the ECHR that the right to conscientious objection to military service is recognized as being fully protected under Article 9 of the Convention and that, as a result, the imprisonment of a conscientious objector is viewed as a violation of fundamental rights in a democratic society.

This milestone decision now places an obligation on three member states of the Council of Europe—Armenia, Azerbaijan, and Turkey—to stop prosecuting and imprisoning individuals whose deeply held religious convictions do not allow them to engage in military service. The 69 Jehovah’s Witnesses who are now imprisoned as conscientious objectors in Armenia await their immediate release from prison. Witnesses view this landmark judgment as a major step forward in the protection of human rights, hoping that countries like South Korea, where there are currently over 800 conscientious objectors in prison, will release imprisoned conscientious objectors in accord with the current international standard upheld by the European Court.
