Judgement and the golden age

24.1 Now for the remainder. The son of God most high and most great will come to judge the living and the dead, as the Sibyl testifies when she says: ‘There will be confusion of men all over earth at the time when the almighty comes in person to his tribunal to judge the souls of the living and the dead and to judge the whole world.’ 2 When he has destroyed injustice and made his supreme judgment and restored to life the just who were so from the start, he will spend a thousand years with men and will rule them with great justice. This is proclaimed by another Sibyl prophesying in a frenzy: ‘Hear me, o mortals: the everlasting king is reigning.’ 3 At that time, those alive in the flesh will not die but will produce children without number during those thousand years, and their offspring will be holy and precious to God; those raised from the underworld will be in charge of the living like judges. 4 Other people will not be wiped out altogether; some will be left for God’s victory, so that the just may triumph over them and put them into perpetual servitude. 5 At the same time even the prince of demons, who is the fabricator of all evils, will be put in chains and kept under guard for the thousand years of heaven’s control, when justice will reign on earth, in case he tries to start any evil against God’s people. 6 After God’s coming the just will gather from all over the world, and after his judgment the holy city will be set up at the centre of earth, and God himself will dwell in it with the just in control. This city is what the Sibyl points to when she says: ‘This is the city that god desired, and he has made it brighter than the stars and sun and moon.’ 7 Then the darkness that clouds the earth and blocks out the sky will be removed from earth, and the moon will take on the sun’s brightness and not be reduced thereafter, and the sun will become seven times brighter than it now is. The earth will disclose its fertility and breed rich fruit of its own accord, the rocks of the hills will ooze with honey, and the rivers will swell with milk; the world itself will rejoice and all nature will be glad at being plucked into freedom from the dominion of evil, impiety, wickedness and error. 8 Wild beasts will not feed on blood in this period, nor birds on prey; everything will instead be peaceful and quiet. Lions and calves will stand together at the stall, wolf will not seize lamb, dog will not hunt, hawk and eagle will do no harm, and children will play with snakes.

9 This will be the time for all those things to happen that the poets claimed for the golden age when Saturn was king. The mistake about them arises from the fact that prophets foretelling the future keep putting plenty forward like that, delivering it as if it has taken place. Visions were put before their eyes by the divine spirit, and they saw things in their sight as if in process and completion. 10 Their words of prophecy were slowly spread by rumour, but those outside God’s mystery did not know their scope; they thought it was all stuff over and done with long before, because it simply could not take place in the reign of a man.

11 When wrong religions have been destroyed, however, and crime has been suppressed, and the earth is subject to God, ‘Merchants will leave the sea, ship’s timbers will not haggle for bargains; all things will grow everywhere on earth. The soil will suffer no ploughshares, the vine no knife; the sturdy ploughman too will release his oxen from the yoke’ [Verg. Ecl. 4.38–41]. Then too, ‘The field will slowly turn yellow with soft awns, and the grape will hang reddening amid uncut brambles, and tough oaks will drip the dewy honey’ [28–30]. ‘Wool will not learn to copy different colours: the ram at pasture will vary his fleece himself, sometimes to a soft pink hue, sometimes to yellow ochre, and red dye will dress the feeding lambs of its own accord’ [42–45]. ‘Nanny goats will bring their milk-distended udders home themselves, and herds will have no fear of great lions’ [21–22].
12 Vergil follows the Sibyl of Cumae in saying this. The Sibyl of Erythrae puts it thus: ‘Wolves and lambs will eat grass on the hills together, and leopards will feed with kids; bears will graze among calves and all cattle, the carnivorous lion will eat bran at the manger, and snakes will bed down with infants.’ 13 Elsewhere, on the fertility of nature: ‘Then god will give men great joy, for earth and trees and the countless offspring of earth will give men the true fruit of wine, sweet honey, white milk and grain, and that is for mortals the most beautiful of all things.’ 14 Again in like fashion: ‘The holy earth, abode of the pious alone, will produce all these things; a stream will flow from a rock dripping honey, and milk too from an immortal spring for all just men.’ 15 People will thus live lives of great peace and plenty, and will reign side by side with God; kings of nations will come from the ends of the earth with offerings and gifts to honour and adore the great king, and his name will be known and revered by all people under heaven and by all kings with dominion on earth.

25.1
This is what the prophets said would happen. I have not thought it necessary to set out what they say in evidence because it would go on for ever; my book could not manage so much material when so many people are saying the same things in the same spirit, and I would not want to bore my readers by piling up stuff gathered from all of them; besides, what I would be saying would simply be confirmation drawn from the writings of others, not my own words, and I would be pointing out that the truth is kept recorded not just with us but also with those very people who keep persecuting us – though it is a truth which they refuse to acknowledge. 2 Anyone wanting to know this more precisely should go to the fountainhead itself: they will discover more wonderful things than I have managed to get into these books of mine.

3 Someone may now ask when these things will happen which we have spoken of. I have already pointed out above that the change should occur at the end of six thousand years, and that the supreme day of final conclusion is already approaching. 4 We can learn from the signs which the prophets have predicted: they have told us the signs by which we should expect the consummation of all time daily and also fear it. 5 The timing of it is set forth by those who have written upon timing; they have searched in holy literature and in various histories for the number of years gone by since the beginning of the world. They differ; their numbers vary somewhat; nevertheless, the universal expectation appears to be for a maximum of two hundred years more. 6 The circumstances themselves make it clear that the slide into ruin will come soon, except that no part of it seems fit to fear as long as Rome is intact. 7 But when the chief city of the world does fall, and the rush starts that the Sibyls predict, then the end will be there without doubt for deeds of men and for the whole world. 8 Rome is the city which has kept everything going so far, and we must pray to God in heaven with due adoration – if, that is, his statutes and decisions can be deferred – that the awful tyrant does not come sooner than we think, that loathsome tyrant with his great task to achieve and the famous light to put out, at whose death the world itself will collapse.

24.1 Τώρα όσον αφορά τα υπόλοιπα. Ο γιος του Θεού του ύψιστου και του μέγιστου θα έρθει για να κρίνει τους ζωντανούς και τους νεκρούς, όπως πιστοποιεί η Σίβυλλα όταν λέει: "Θα υπάρξει σύγχυση στους ανθρώπους σε όλη τη γη τον καιρό που ο παντοδύναμος θα έρθει προσωπικά στη δικαστική έδρα για να κρίνει τις ψυχές των ζωντανών και των νεκρών και για να κρίνει όλο τον κόσμο". 2 Όταν θα έχει καταστρέψει την αδικία και θα έχει  επιτελέσει την υπέρτατη κρίση του και θα έχει επαναφέρει στη ζωή τους δίκαιους που ήταν τέτοιοι εξ αρχής, θα δαπανήσει χίλια χρόνια μαζί με τους ανθρώπους και θα τους κυβερνήσει με μεγάλη δικαιοσύνη. Αυτό διακηρύττεται από μια άλλη Σίβυλλα σε έκσταση: "Ακούστε με, ω θνητοί: Ο αιώνιος βασιλιάς κυβερνάει". 3 Εκείνο τον καιρό, όσοι θα είναι ζωντανοί στη σάρκα δεν θα πεθαίνουν αλλά θα τεκνοποιούν αναρίθηματα παιδιά στη διάρκεια εκείνων των χιλίων ετών, και οι απόγονοί τους θα είναι άγιοι και πολύτιμοι για τον Θεό· όσοι εγέρθηκαν από τον άδη θα είναι υπεύθυνοι στους ζωντανούς σαν κριτές. 4 Κάποιοι άνθρωποι θα διαφύγουν από τον αφανισμό· θα παραμείνουν κάποιοι ζωντανοί για χάρη της νίκης του Θεού, έτσι ώστε οι δίκαιοι θα θριαμβεύσουν πάνω τους και θα τους θέσουν στην υπηρεσία τους αιώνια. 5 Εκείνον επίσης τον καιρό ακόμη και ο άρχοντας των δαιμονίων, που είναι η αιτία όλων των κακών, θα δεθεί με αλυσίδες και θα φυλακιστεί για τα χίλια χρόνια που θα υπάρχει ο ουράνιος έλεγχος, τότε που η δικαιοσύνη θα κυβερνάει πάνω στη γη, σε περίπτωση που θα προσπαθήσει να ξεκινήσει κάτι κακό εναντίον του λαού του Θεού. 6 Μετά την έλευση του Θεού οι δίκαιοι θα συγκεντρωθούν από όλο τον κόσμο, και μετά την κρίση του η άγια πόλη θα θεμελιωθεί στο κέντρο της γης, και ο ίδιος ο Θεός θα κατοικεί σε αυτήν έχοντας τον έλεγχο των δικαίων. Αυτή την πόλη υποδεικνύει η Σίβυλλα όταν λέει: "Αυτή είναι η πόλη που είναι επιθυμητή από τον Θεό, και την οποία έκανε λαμπρότερη από τα άστρα, τον ήλιο και το φεγγάρι". 7 Κατόπιν το σκοτάδι που σκεπάζει τη γη και δεν αφήνει να φανεί ο ουρανός θα απομακρυνθεί από τη γη, και το φεγγάρι θα αποκτήσει τη λαμπρότητα του ήλιου και δεν θα χάσει τη λαμπρότητά του έκτοτε, και ο ήλιος θα γίνει εφτά φορές λαμπρότερος απ' ό,τι είναι τώρα. Η γη θα εκδηλώσει όλη την παραγωγικότητά της και θα καρποφορεί πλούσια  κατά την ποικιλία τους, από τους βράχους των λόφων θα ρέει μέλι, και τα ποτάμια θα φουσκώνουν από γάλα· ο κόσμος θα χαίρεται και όλη η φύση θα είναι χαρούμενη καθώς θα έχει φερθεί στην ελευθερία από την κυριαρχία του κακού, της ασέβειας, της πονηρίας και των σφαλμάτων. 8 Τα άγρια ζώα δεν θα τρέφονται με αίμα αυτή την περίοδο, ούτε τα πουλιά με θηράματα· αντίθετα, όλα θα είναι ειρηνικά και ήσυχα. Τα λιοντάρια και τα μοσχάρια θα ζουν μαζί στο παχνί, ο λύκος δεν θα αρπάζει το αρνί, ο σκύλος δεν θα κυνηγάει, το γεράκι και ο αετός δεν θα βλάπτουν, και τα παιδιά θα παίζουν με τα φίδια.

9 Αυτός θα είναι ο καιρός που θα συμβούν όλα αυτά τα πράγματα για τα οποία οι ποιητές δήλωσαν σχετικά με τη χρυσή εποχή όταν θα είναι βασιλιάς ο Σατούρνους [δηλ. ο Κρόνος]. Το λάθος από μέρους τους [ενν. των ποιητών] προκύπτει από το γεγονός ότι οι προφήτες που προέλεγαν το μέλλον εκφράζονταν για κάτι πολύ μεταγενέστερο, αναφερόμενοι σε αυτό σαν να είχε ήδη συμβεί. Τα οράματα δίνονταν ενώπιόν τους μέσω του θεϊκού πνεύματος, και έβλεπαν πράγματα μέσω της όρασής τους σαν να είχαν ήδη εφαρμοστεί και εκπληρωθεί. 10 Τα λόγια της προφητείας τους διαδίδονταν αργά μέσω φημών, αλλά όσοι ήταν έξω από το μυστήριο του Θεού δεν γνώριζαν τον σκοπό τους· νόμιζαν ότι όλα αυτά τα πράγματα ήταν περασμένα και ότι είχαν τελειώσει πριν από πολύ καιρό, επειδή απλά δεν θα μπορούσε να συμβεί κάτι τέτοιο κατά τη βασιλεία κάποιου ανθρώπου.


11 Όταν οι λανθασμένες θρησκείες θα έχουν καταστραφεί, όμως, και το έγκλημα θα έχει κατασταλεί, και η γη θα είναι υποταγμένη στον Θεό, "Οι περιοδεύοντες έμποροι θα αφήσουν τη θάλασσα, η ξυλεία των πλοίων δεν θα παζαρεύεται για έκπτωση· τα πάντα θα φύονται παντού στη γη. Το χώμα δεν θα υποφέρει από τα υνία, το κλήμα από το μαχαίρι· ο δυνατός ζευγάς επίσης θα ελευθερώσει τα βόδια του από το ζυγό" [Βιργίλ. Εκλ. 4:38-41]. Τότε επίσης, "Ο αγρός θα γίνει σταδιακά κίτρινος από τους απαλούς αθέρες, και τα τσαμπιά των σταφυλιών θα κρέμονται για να κοκκινίσουν ανάμεσα στους ακλάδευτους βάτους, και οι σκληρές βελανιδιές θα στάζουν μέλι σαν τη δροσιά" [28-30]. "Το μαλλί δεν θα μαθαίνει να αντιγράφει τα διάφορα χρώματα: το κριάρι στο βοσκότοπο θα ποικίλει το μαλλί του από μόνο του, κάποιες φορές σε απαλή ροζ απόχρωση, κάποιες φορές σε κίτρινο της ώχρας, και η κόκκινη βαφή θα ντύνει τα αρνιά που τρέφονται το καθένα κατά το είδος του" [42-45]. Οι κατσίκες που παράγουν γάλα θα φέρνουν τους διογκωμένους από το γάλα μαστούς τους στο σπίτι από μόνες τους, και τα κοπάδια δεν θα φοβούνται τα μεγάλα λιοντάρια" [21-22]. [...]

Ο εισηγητής [Αντ. Πινακούλας] ξεκινάει αναφερόμενος στην ιδέα της Βασιλείας του Θεού. Κατά την άποψή του, αυτή εμφανίζεται συνήθως με δύο τρόπους:
«Είτε ως χιλιαστική προσδοκία βίαιης ανατροπής του αμαρτωλού κόσμου είτε ως πρόγραμμα βαθμιαίας χριστιανοποίησής του» (σελ. 129).
Πράγματι, θα συμφωνήσω ότι ο χριστιανικός χιλιασμός, στη γνήσια μορφή του, σημαίνει τη βίαιη ακύρωση και αντικατάσταση των ανθρώπινων κυβερνήσεων από την ουράνια κυβέρνηση. Ενώ στη δεύτερη περίπτωση θεωρείται ότι η ουράνια κυβέρνηση εκφράζεται μέσω των ανθρώπινων κυβερνήσεων. Εν προκειμένω, ο
«βυζαντινός μεσσιανισμός είναι η συνείδηση των κατοίκων του ανατολικού ρωμαϊκού κράτους ότι η αυτοκρατορία ήταν η πραγμάτωση του χριστιανικού ιδεώδους από τη στιγμή που την κυβέρνησή της ανέλαβαν οι χριστιανοί» (σελ. 130).
Βέβαια, ένα καλό ερώτημα είναι πώς και γιατί έγινε η μετάβαση από τον χιλιασμό στον βυζαντινό μεσσιανισμό. Ο εισηγητής αναφέρει ότι την οδό προετοίμασαν Πατέρες όπως ο Μελίτων Σαρδέων και ο Ωριγένης. Τούτοι υποστήριξαν την κοινή μοίρα και τη σύγκλιση μεταξύ Αυτοκρατορίας και Εκκλησίας κατά τη βούληση του Θεού, έτσι ώστε να μπορεί να λεχθεί μάλιστα ότι οι διωγμοί δεν αποτέλεσαν παρά ατυχήματα λόγω άγνοιας της εξουσίας (σελ. 131, 134). Ο εισηγητής παρατηρεί ότι αυτή η αντίληψη
«κυοφορήθηκε για έναν αιώνα μετά τη διάψευση ενός επικείμενου τέλους της ιστορίας, που προσδιοριζόταν στην αρχή στα όρια μιας γενιάς» (σελ. 133).
Πράγματι, φαίνεται ότι η απογοήτευση για το ότι δεν εγκαθιδρύθηκε η χιλιετής βασιλεία του Θεού τόσο σύντομα όσο αναμενόταν άνοιξε τον δρόμο για την «επανερμηνεία» του μεσσιανισμού (Βλ. Ματθαίος 25:5· Λουκάς 20:11, 12). Ως αποτέλεσμα, με τον καιρό, παρά την αρχική «αρνητική θεώρηση του ρωμαϊκού κράτους», «χρωματίζεται όλο και πιο θετικά η θέση του ανάμεσα στον παρόντα χρόνο και σε εκείνον του Αντιχρίστου» (σελ. 141).

Το Δωδεκαήμερο των Χριστουγέννων αντικατέστησε πιθανότατα αρχαιοελληνικές ή ρωμαϊκές γιορτές, όπως τα Σατουρνάλια, τα Κρόνια κ.ά., συνδεδεμένες με τις χειμερινές τροπές του ήλιου (το χειμερινό ηλιοστάσιο στις 22 Δεκεμβρίου).

Περιλαμβάνει τις ημέρες από την παραμονή των Χριστουγέννων (24 Δεκεμβρίου) έως την παραμονή των Θεοφανείων (5 Ιανουαρίου). Έτσι, είναι φυσικό, οι χριστιανικές γιορτές, όπως είναι η Γέννηση του Χριστού, η εορτή του Αγίου Βασιλείου, η Περιτομή και η Βάπτιση να έχουν συνδεθεί με ειδωλολατρικές συνήθειες που αποσκοπούσαν στον εξευμενισμό των δαιμονικών όντων και στην ευετηρία (καλοχρονιά).

Κύριο χαρακτηριστικό των ημερών αυτών είναι οι αγερμοί (κάλαντα) από μικρούς και μεγάλους, οι μεταμφιέσεις, οι προληπτικές ενέργειες για το καλό της χρονιάς κ.ά.

Τα χοιροσφάγια
Μια χαρακτηριστική εκδήλωση των Χριστουγέννων είναι τα χοιροσφάγια, με θυσιαστικό χαρακτήρα, απήχηση αρχαίων εξιλαστήριων και καθαρτήριων θυσιών που συνοδεύονται από μαγικές και δεισιδαιμονικές πράξεις, όπως τα μαντέματα. Οι Ρωμαίοι στην εορτή των Βρουμαλίων στο τέλος του έτους θυσίαζαν χοίρους στον Κρόνο και τη Δήμητρα. Ο χοίρος είναι πιθανότατα μία ενσάρκωση του βλαστικού και γονιμικού δαίμονα, είτε επειδή καταστρέφει τη βλάστηση είτε και εξαιτίας της πολυτοκίας του.

Στον παραδοσιακό πολιτισμό η λατρεία είναι ενσωματωμένη στην αγροτική οικονομία. Η εκτροφή του χοίρου εξασφαλίζει στην οικογένεια κρέας και λίπος για ολόκληρη τη χρονιά. Δεν ήταν δύσκολο να διατηρούν από ένα χοίρο σε κάθε σπίτι καθώς ασχολούνταν με τη γεωργία και την κτηνοτροφία και είχαν να τον ταϊσουν σιτηρά, τυρόγαλο, βελανίδια και αποφάγια αντί να τα πετάνε.

Για τη σφαγή ακολουθούνταν ιδιαίτερη εθιμοτυπία καθώς γινόταν με ειδικό μαυρομάνικο μαχαίρι και θύτης ήταν ο αρχηγός της οικογένειας. Από το αίμα του ζώου έγραφαν ένα σταυρό στο μέτωπο των μικρών παιδιών για τον πονοκέφαλο.

Κάρφωναν το ρύγχος του χοίρου στον τοίχο ή πάνω από την πόρτα για να διώχνει τους καλικαντζάρους. Από τη σπλήνα και το συκώτι του μάντευαν το μέλλον της οικογένειας.

Έπειτα μαζεύονταν στα σπίτια και δοκίμαζαν τους χοιρινούς μεζέδες και παρασκεύαζαν τα λουκάνικα, τα απάκια και τα σύγλινα. Ιδιαίτερα φιλανθρωπικό χαρακτήρα αλληλεγγύης προς τον συνάνθρωπο είχε η συνήθεια να στέλνουν «τα σκουτελικά για ψυχικό» δηλαδή καλάθια με δώρα, κυρίως φαγώσιμα.

Τα Χριστούγεννα και τα έθιμά τους
Η γιορτή των γενεθλίων του Χριστού θεσπίστηκε στις 25 Δεκεμβρίου από τους Χριστιανούς και ο εορτασμός της επεκτάθηκε σταδιακά σε όλο το ρωμαϊκό κράτος, ανατολικό και δυτικό. Στόχος τους ήταν να παραμερίσουν τον περσικό θεό Μίθρα, θεό του ήλιου και του φωτός. Η μέρα των γενεθλίων του «το Γενέθλιον του αήττητου Ήλιου» γιορταζόταν στις 25 του Δεκέμβρη. Η γιορτή αυτή συνδυαζόταν με τα Σατουρνάλια, παλιά αγροτική γιορτή που έγινε μία από τις σπουδαιότερες γιορτές των Ρωμαίων και γιορταζόταν από τις 17 έως τις 23 Δεκεμβρίου.

Ο σύνδεσμος του Χριστού με τον ήλιο φανερώνεται και στην υμνογραφία των Χριστουγέννων: «Ανέτειλας, Χριστέ, εκ Παρθένου, νοητέ Ήλιε της Δικαιοσύνης». Η γέννηση του Χριστού γιορταζόταν αρχικά στις 6 Ιανουαρίου, μαζί με τη βάπτιση. Το 378 για πρώτη φορά γιορτάστηκαν στην Κωνσταντινούπολη τα Χριστούγεννα ως αυτοτελής γιορτή.

Προάγγελος των Χριστουγέννων είναι οι ομάδες των παιδιών που τραγουδούν τα κάλαντα. αρχίζοντας με την εξιστόρηση της γέννησης του Χριστού, συνεχίζουν με παινέματα για το σπίτι και τους σπιτικούς και τελειώνουν ζητώντας πλούσιο φιλοδώρημα.

Στο Ζαγόρι της Ηπείρου για παράδειγμα, ξημερώνοντας Χριστούγεννα, κάνουν τα «σπάργανα», τηγανίτες με πολλά καρύδια επάνω που συνηθίζουν να προσφέρουν σε όσους επισκέπτονται λεχώνα. Το Δωδεκαημέρου που μεσολαβεί ανάμεσα στη γέννηση και τη βάπτιση του Χριστού είναι μια ιδιαίτερη χρονική περίοδος. Αν για τα μικρά αβάπτιστα παιδιά και τις λεχώνες παίρνονται ιδιαίτερες προφυλάξεις για να τα προστατεύσουν καθώς είναι ευάλωτα στις επιβουλές και συνάμα επικίνδυνα, ο χρόνος που μεσολαβεί ως τη βάπτιση του Χριστού είναι χρόνος αταξίας που αφορά ολόκληρη την παραδοσιακή κοινωνία.

Τα Χριστούγεννα αποτελούν οικογενειακή γιορτή, που συγκεντρώνει τα μέλη της οικογένειας γύρω από το κοινό τραπέζι, όπου θα κόψουν το χριστόψωμο, στολισμένο με καρύδια και σχέδια από ζυμάρι. Στη Μακεδονία και αλλού τα Χριστούγεννα μαγείρευαν ντολμαδάκια (σαρμάδες) με λάχανο και κρέας χοιρινό, συνοδευμένο με σέλινο, πράσο ή σπανάκι, ενώ σε άλλες περιοχές έσφαζαν κότα και έφτιαχναν σούπα. Η γαλοπούλα είναι νεώτερη συνήθεια στο χριστουγεννιάτικο τραπέζι.

Τα κάλαντα των Χριστουγέννων
Τα κάλαντα είναι τραγούδια που λέγονται από ομάδες παιδιών ή ενηλίκων στους δρόμους ή τα σπίτια με φιλοδώρημα. Πήραν το όνομά τους από τη γιορτή των Καλενδών του ρωμαϊκού ημερολογίου.

Την παραμονή των Χριστουγέννων παιδιά ή άντρες γυρνούσαν από σπίτι σε σπίτι κι έλεγαν τα κάλαντα. Στη Χίο το βράδυ της παραμονής ομάδες παιδιών ή άντρες γύριζαν στα σπίτια με τύμπανα και φλογέρες ή με μουσική και έψαλλαν τα Χριστουγεννιάτικα κάλαντα.
Στην περιοχή Κοζάνης κρατούσαν ένα ξύλο μήκους μισού μέτρου και σχήματος Τ (την τζομπανίκα) για να χτυπούν τις πόρτες και ένα τροβά (υφαντό σακούλι για τα δώρα). Οι νοικοκυρές τους «φιλεύουν» μήλα, σύκα, καρύδια, κάστανα, κουλουράκια (κολιαντίνες), αβγά, χρήματα κ.ά.

Στην Ήπειρο τραγουδούσαν:
Κόλιαντα , μπάμπω, κόλιαντα,
Και μένα κολιαντίνα
Κι αν δεν μου δώσεις
Κι αν δεν μου δώσης κόλιαντα,,
Δώσ' μας την θυγατέρα σ'.
-Τι την θέλεις, τη δική μου θυγατέρα
-Να την φιλώ να την τσιμπώ
να με ζεσταίνει το βράδυ
Φέρτε μας τα κόλιαντα,
Τι μας πήρ' η μέρα.
Η μέρα μερουλίζει
Το πουλί τσουρίζει.
Η γάτα νιαουρίζει,
Ο Χριστός γεννιέται,
Γεννιέται και βαφτίζεται
Στους ουρανούς απάνω.
Οι άγγελοι χαίρουνται
Και τα δαιμόνια σκάνουν (=σκάνε)
Σκαίνουν και πλαντάζουν
Τα σίδερα δαγκάνουν

Το χριστουγεννιάτικο δέντρο
Το χριστουγεννιάτικο δέντρο φαίνεται ότι εμφανίστηκε στη νεώτερη Ελλάδα την εποχή του Όθωνα. Βέβαια μόνο ύστερα από τον τελευταίο πόλεμο εκλαϊκεύτηκε και αγαπήθηκε ως χριστουγεννιάτικο στολίδι. Είναι γερμανικό και σκανδιναβικό έθιμο και από εκείνους τους λαούς το έμαθαν και οι άλλοι. Η χρήση πράσινων κλαδιών αειθαλών δένδρων υπήρχε και στις αρχαίες γιορτές των «δεντροφοριών» και στις ρωμαϊκές και βυζαντινές καλένδες. Το δέντρο με τα αναβλαστικά σχήματα και το πράσινο χρώμα ήταν πάντα ένα σύμβολο ζωής. Όσον αφορά το στολισμένο καραβάκι τα παιδιά των νησιών και των παραθαλασσίων περιοχών τραγουδούσαν τα κάλαντα κρατώντας φωτισμένα καράβια σαν φαναράκια. Στην Ηπειρωτική και Ορεινή Ελλάδα κρατούσαν επίσης φανάρι, μια εκκλησία, ένα ομοίωμα της αγιας-Σοφιάς.

Οι καλικάντζαροι
Οι καλικάντζαροι έρχονταν την παραμονή των Χριστουγέννων και έφευγαν τα Θεοφάνεια. Έχουν διάφορες ονομασίες: Λυκοκαντζαραίοι, σκαρικατζέρια, καρκατζέλια, πλανήταροι (Κύπρος), Κάηδες (Σύμη), καλλισπούδηδες, χρυσαφεντάδοι (Πόντος), κωλοβελόνηδες, παρωρίτες ή παραωρίτες (πριν από το λάλημα του πετεινού), παγανά. Με παρεμφερή ονόματα υπάρχουν οι καλικάντζαροι και στους βαλκανικούς λαούς. Και στους άλλους χριστιανικούς λαούς εμφανίζονται δοξασίες για δαιμονικά όντα κατά το Δωδεκαήμερο: Λυκάνθρωποι, Στρίγγλες, Μάγισσες, Νόρνες.

Συμβολίζουν το σκοτάδι και ζουν όλο το χρόνο στα έγκατα της γης, προσπαθώντας να κόψουν το δέντρο που βαστάει τη γη. Όταν είναι πολύ κοντά να το πετύχουν, την παραμονή των Χριστουγέννων ανεβαίνουν στη γη δημιουργώντας προβλήματα στους ανθρώπους. Η πίστη για τους καλικαντζάρους ως δαιμονικών όντων που ζουν κάτω από τη γη στηρίζεται στην κοσμοθεωρία περί ακινησίας της γης. Μένουν ανάμεσα στους ανθρώπους δώδεκα ημέρες ως την παραμονή των Φώτων αφήνοντας στην ησυχία του το δέντρο της Ζωής να αναβλαστήσει.

Ο λαός τους φαντάζεται μαύρους και άσχημους, κουτσούς, ψηλούς με μάτια κόκκινα, πόδια τραγίσια και σώμα τριχωτό. Οι άνθρωποι προσπαθούσαν να τους εξουδετερώσουν με διάφορους τρόπους και κυριότερα με τη φωτιά, η οποία καίει συνεχώς στο τζάκι όλο το Δωδεκαήμερο. Διάλεγαν ένα κούτσουρο («δωδεκαμερίτης», «χριστόξυλο») και μάλιστα από αγκαθωτό δέντρο. Με τη στάχτη του ράντιζαν το σπίτι ξημερώματα παραμονής Θεοφανείων τρέποντας σε φυγή τα δαιμόνια.

Σύμφωνα με μια παράδοση: «Οι Λυκοκαντζαραίοι έρχονται από τη γης αποκάτου. Ούλο το χρόνο πελεκάν με τα τσεκούρια να κόψουν το δέντρο που βαστάει τη γης. Κόβουν κόβουν όσο που μενέσκει λιγάκι ακόμα ως μια κλωνά άκοπο, και λεν «χάισε να πάμε, και θα πέση μοναχό του».

Και στα νησιά φτάνουν οι καλικάντζαροι. Με το καράβι τους. Κάνουν ζημιές: Χύνουν το νερό, τ' αλεύρι, κατουρούν τη στάχτη. Γι αυτό και βάζουν στη φωτιά ρείκια, αλάτι, που κάνουν κρότο, ή ρίχνουν κανένα πετσί να βρωμάει».

Ο λαός πιστεύει ότι Καλικάντζαροι γίνονται όσοι γεννιούνται το Δωδεκαήμερο, γιατί έχουν συλληφθεί την ίδια μέρα με το Χριστό. Θέλουν να κάνουν κακό στους ανθρώπους. Είναι άσκημοι, κουτσοί, εριστικοί, ανόητοι γιατί δεν βοηθά ο ένας τον άλλον και για το λόγο αυτό είναι αναποτελεσματικοί στο να κάνουν κακό. Όσους περπατούσαν τη νύχτα έξω τους ανάγκαζαν να χορέψουν μαζί τους (είναι χαρακτηριστικό το παραμύθι με τη Μάρω που γύριζε από το μύλο τη νύχτα).

Οι μυλωνάδες που εργάζονταν στο μύλο, ο οποίος ήταν συνήθως χτισμένος σε μέρος μακριά από τον καθαγιασμένο χώρο του οικισμού δίπλα σε ποτάμι, είχαν πάρε δώσε με καλικαντζάρους. Τα Φώτα όλα τα πονηρά πνεύματα φεύγουν με τον αγιασμό..

Το «Χριστόξυλο»
Κλαδιά δέντρων, ανάλογα με την περίσταση, χρησιμοποιούνται κατά τη διάρκεια της χρονιάς για στολισμό, επίτευξη γονιμότητας, αποτροπή επιβλαβών ζωυφίων, προστασία από τη βασκανία και γενικά για ευεργετική επίδραση σε ανθρώπους, ζώα και κτήματα.

Έτσι η ελιά σύμβολο μακροβιότητας, γονιμότητας και ευτυχίας εξαιτίας του αειθαλλούς της φυλλώματος και του εξαιρετικά θρεπτικού και υγιεινού καρπού της, χρησιμοποιήθηκε και εξακολουθεί να έχει την μεγαλύτερη χρήση στα χαρακτηριστικά περάσματα του ανθρώπινου κύκλου της ζωής (από τη γέννηση ως το θάνατο), αλλά και στον κύκλο του χρόνου (από τα Χριστούγεννα, την Πρωτοχρονιά, την Πρωτομαγιά). Αλλά και το πουρνάρι (δρυς, δέντρο), η καρυδιά, η κρανιά, η μηλιά κ.ά. χρησιμοποιούνται εθιμικά για τον αποχρωματισμένο τελετουργικά στολισμό των σπιτιών κατά τη διάρκεια του χρόνου.

Στη Χίο το βράδυ της παραμονής ομάδες παιδιών ή άντρες γύριζαν στα σπίτια με τύμπανα και φλογέρες ή με μουσική και έψαλλαν τα Χριστουγεννιάτικα κάλαντα.

Ὁ δὲ αὐτὸς βασιλεὺς Θεοδόσιος ἐν τῷ αὐτῷ χρόνῳ τοὺς τρεῖς ναοὺς τοὺς ὄντας ἐν Κωνσταντινουπόλει εἰς τὴν πρῴην λεγομένην Ἀκρόπολιν καταλύσας, ἐποίησε τὸν τοῦ Ἡλίου ναὸν αὐλὴν οἰκημάτων, καὶ ἐδωρήσατο αὐτὴν τῇ μεγάλῃ ἐκκλησίᾳ Κωνσταντινουπόλεως· ἥτις αὐλὴ κέκληται ἕως τοῦ νῦν τοῦ Ἡλίου· τὸν δὲ τῆς Ἀρτέμιδος ναὸν ἐποίησε ταβλοπαρόχιον τοῖς κοττίζουσιν· ὅστις τόπος κέκληται ἕως τῆς νῦν ὁ ναός· ἡ δὲ πλησίον ῥύμη τὸ ἐλάφιν. τὸν δὲ τῆς Ἀφροδίτης ναὸν ἐποίησε καρουχαρεῖον τοῦ ἐπάρχου τῶν πραιτωρίων, κτίσας πέριξ ὁσπήτια καὶ κελεύσας δωρεὰν μένειν ἐν αὐτοῖς τὰς πάνυ πενιχρὰς πόρνας. ἐποίησε δὲ ὁ αὐτὸς Θεοδόσιος καὶ τὴν λεγομένην πρῴην κώμην Ῥοφαεινᾶν πόλιν· ἥτις μετεκλήθη Θεοδοσιούπολις, λαβοῦσα ἔκτοτε ἡ αὐτὴ κώμη καὶ δίκαιον πόλεως ἕως τῆς νῦν, ἐπὶ τῆς ὑπατείας Μηροβαύδου καὶ Σατουρνίνου.

Ὁ δὲ αὐτὸς Θεοδόσιος ἐπὶ τῆς ἑαυτοῦ βασιλείας ἐποίησε τὴν σύνοδον τῶν ρνʹ ἐπισκόπων τῶν ἐν Κωνσταντινουπόλει ἕνεκεν τοῦ ὁμοουσίου τοῦ ἁγίου πνεύματος. [...]

Ὁ δὲ αὐτὸς Θεοδόσιος βασιλεὺς ἀπὸ Κωνσταντινουπόλεως ἐξελθὼν ἐπὶ Ῥώμην εἰσῆλθεν ἐν Θεσσαλονίκῃ πόλει· καὶ τοῦ ὄντος μετ’ αὐτοῦ στρατιωτικοῦ πλήθους διὰ μιτᾶτα ταράξαντος τὴν πόλιν, ἐστασίασαν καὶ ὕβρισαν τὸν βασιλέα οἱ Θεσσαλονικεῖς. καὶ θεωρήσας ἱππικὸν ἐν τῇ αὐτῇ πόλει γέμοντος τοῦ Ἱππικοῦ ἐκέλευσε τοξευθῆναι· καὶ ἀπώλετο πλῆθος χιλιάδων δεκαπέντε. καὶ διὰ τοῦτο ἀγανακτήσας κατ’ αὐτοῦ Ἀμβρόσιος ὁ ἐπίσκοπος ἐποίησεν αὐτὸν ὑπὸ κώλυμα· καὶ ἔμεινεν ἐπὶ πολλὰς ἡμέρας μὴ εἰσερχόμενος εἰς τὴν ἐκκλησίαν, ἕως οὗ παρακληθεὶς ὁ ἐπίσκοπος εἰς τὰ ἅγια γενέθλια ἐδέξατο αὐτόν. οὐκ ἄλλως δὲ ἐδέξατο αὐτόν, ἕως οὗ ἐποίησε σάκραν, ἵνα οἱασδήποτε ἀγανακτήσεως παρὰ βασιλέως γινομένης ἔνδοσιν δίδοσθαι ἀπὸ τῶν ἐπιτρεπομένων τριάκοντα ἡμερῶν καὶ εἶθ’ οὕτως γενέσθαι τὸ προσταχθέν.


After the reign of Gratian, the senate of Constantinople proclaimed as emperor Theodosius, who was related to the imperial family and came from the land of Spain. After being proclaimed by the senate, the most sacred Theodosius the Great, the Spaniard, the brother-in-law of Gratian, reigned for 17 years. He was a Christian, and a sensible, pious and energetic man. As soon as he began to reign, he immediately returned the churches to the Orthodox, issuing rescripts everywhere and expelling the Arians. The emperor crowned his two sons whom he had by his first wife, Galla, and made Arcadius emperor in Constantinople and Honorius in Rome. The emperor Theodosius razed all the shrines of the Hellenes to the ground. He also destroyed the large and famous temple of Helioupolis, known as Trilithon, and made it a church for the Christians. Likewise he made the temple of Damascus a Christian church. He made many other temples into churches and Christianity advanced further during his reign. [...]

The emperor Theodosius in that year pulled down the three temples in Constantinople on what was formerly known as the Acropolis. He made the temple of Helios into a courtyard surrounded by houses and donated it to the Great Church of Constantinople. This courtyard is called the "Courtyard of Helios" to the present day. The temple of Artemis he made into a gaming room for dice players. This place is called "The Temple" to the present day, and the street nearby is called "The Fawn". The temple of Aphrodite he made into a carriage-house for the praetorian prefect, and he built lodging-houses close by and gave orders that penniless prostitutes could stay there free of charge. Theodosius made the village formerly known as Resaina into a city, which was renamed Theodosioupolis; the village received the status of a city during the consulship of Merobaudes and Saturninus, from that date to the present day.

During his reign Theodosius held the Council of 150 Bishops in Constantinople concerning the consubstantiality of the Holy Spirit. [...]

The emperor Theodosius left Constantinople for Rome and entered the city of Thessalonike. The military force which was with him caused an uproar in the city over billeting, and so the inhabitants of Thessalonike rioted and insulted the emperor; and when he was watching the races in the city with the hippodrome full, he ordered his archers to shoot at the crowd and as many as 15,000 were killed. Bishop Ambrose was angry with him because of this and placed him under interdict. He remained many days without entering the church, until the bishop was persuaded to receive him at the feast of the Holy Nativity. But he only agreed to receive him when he had issued an imperial rescript that, in any case of imperial displeasure, whatever its nature, a remission should be granted by the arbitrators for 30 days and only then should the sentence be carried out.

Yet in his hostility to the antiquity of the doctrine of the Trinity, Newton was taking a position in opposition to that of other prominent Dutch and English writers of the mid- to late seventeenth century. Vossius and Grotius had made detailed studies of pagan religious practices, and claimed to show how they all had their origins in Judaeo-Christian belief. Newton’s Cambridge colleagues Ralph Cudworth and Henry More both defended the antiquity of the Trinity. Cudworth’s reading of the ancient sources indicated to him that trinitarian theology could be found in Orpheus, Pythagoras, and Plato, and in the arcane theology of the Egyptians, Persians, and Romans.

Nevertheless, there was growing opposition in Newton’s day to the authenticity of Trinitarianism. In 1690 in Vindication of the Unitarians the Oxford-educated lawyer William Freke had defined the Trinity as ‘the stumbling block in Christianity’. Similarly in 1695 the Cambridge-educated theologian Stephen Nye—who had already claimed that Socinianism (an antitrinitarian heresy similar to Arianism) was the heir to pristine monotheistic Christianity—argued in a counter-argument to Cudworth that trinitarian Christianity could claim to have no ancient tradition. It was, rather, made up of ‘Novelties, corruptions, and depravities of genuine Christianity’. This controversy was largely silenced by the terms of the Blasphemy Act of 1697, but the trinitarian question re-emerged in the second decade of the eighteenth century when Clarke and Whiston both publicly expounded and published antitrinitarian opinions they had learnt from Newton.

GREECE (*)




1.                           Is there specific legislation prohibiting blasphemy and/or religious insult in your country ? Can this be explained on the basis of :

a)         historical grounds, and if so which ones?
b)         doctrinal grounds, and if so which ones?
c)         other grounds

The Chapter 7 of the Greek Penal Code is entitled Plots Against Religious Peace and contains four articles.

According to Article 198 “Malicious Blasphemy”:
1. One who publicly and maliciously and by any means blasphemes God shall be punished by imprisonment for not more than two years.  2. Except for cases under paragraph 1, one who by blasphemy publicly manifests a lack of respect for the divinity shall be punished by imprisonment for not more than three months.”
According to Article 199 “Blasphemy Concerning Religions”:
One who publicly and maliciously and by any means blasphemes the Greek Orthodox Church or any other religion tolerable in Greece shall be punished by imprisonment for not more than two years.”

According to Article 200 “Disturbance of a Religious Assembly”:
1. One who maliciously attempts to obstruct or intentionally disrupts a religious assembly for service or ceremony permitted under the Constitution shall be punished by imprisonment for not more than two years.
2. One who commits blasphemous, improper acts in a church or in a place devoted to a religious assembly permitted under the Constitution shall be subject to the same punishment.”

According to Article 201:
One who willfully removes a corpse, parts of a corpse or the ashes of the dead from those who wave lawful custody thereof or one who commits an offense with respect to a corpse or acts blasphemously and improperly toward a grave, shall be punished by imprisonment for not more than two years.”

Chapter 7 of the Greek Penal Code is a rather obvious indication that the Greek criminal order is a religionist one.  The Greek legal order is marked by a very high level of religious devotion, result of the particular position of the Greek Orthodox Church in the State, according to the Greek Constitution. Furthermore, the solid historical links between the Eastern Orthodox Christianity and the emergence of the Greek nation, are used in order to justify a high level of interference of the church in the state affairs, in all different levels.  The very existence of Chapter 7 of the Greek Penal Law can be regarded as a solid material of the integration of the Orthodox religion into the penal machinery. It should not be regarded as accidental therefore, that the Greek case law related to crimes contained in the Chapter 7 of the Code is inexistent when it comes to condemnation of blasphemous acts against “any other religion tolerable in Greece”.

It should be noted finally that the target of punishing blasphemy in the Greek penal law is neither the protection of the religious feeling nor social peace as it is often alleged in parts of the doctrine. Article 198 of the Penal Code does neither refer to the victim of the insult nor the religious convictions of third individuals witnessing a blasphemous act. The object of the penal interest here is sole the concept or the existence of God, as a value per se deserving penal protection regardless of the sacred beliefs of any individual. This rather peculiar situation for penal law means that God’s protection by penal means is recognized as an independent legal value, integrated in the state’s order, regardless of the persons’ beliefs. The victim of the crime of blasphemy is not a concrete religion, an individual believer or a group of believers but the divine, as such.


2.                  Is there specific legislation prohibiting religious hatred? Is there, in addition or instead, more general legislation prohibiting hate speech and/or incitement to violence, and/or defamation, and/or discriminatory speech? Could this situation be explained on the basis of:

a)        historical grounds, and if so which ones?
b)        doctrinal grounds, and if so which ones?
c)         other grounds?

Article 192 of the Greek Penal Code reads as follows: “One who publicly and by any means causes or incites citizens to commit acts of violence upon each other or to disturb the peace through disharmony among them shall be punished by imprisonment for not more than two years unless a greater punishment is imposed by another provision.”

Furthermore, special criminal legislation - L.927/1979 amended by article 24 of the L.1419/1984 – punishes acts aiming at racial discriminations.

According to the L.927:

Article 1.
1. One who publicly, orally or through the Press or written texts, pictures or by any means intentionally incites to acts or actions potentially able to cause discrimination, hatred or violence against persons or groups of persons on the sole basis of their racial or national origin shall be punished by imprisonment for not more than two years or pecuniary penalty or both.
2. With the above mentioned penalties is punished one who constitutes or participates in organizations who intent organized propaganda or activities of any kind aiming at racial discriminations.   

Article 2.
One who publicly, orally or through the Press or written texts, pictures or by any means, expresses insulting ideas against persons or groups of persons on the sole basis of their racial or national origin, shall be punished by imprisonment for not more than one year or pecuniary penalty or both.

Article 24 of L 1419/1984 adds the word “religion” next to racial or national origin.
According to leading scholars of Greek penal law, the normative content of the articles belonging in the Chapter 6 “Plots against the public order” (where article 192 belongs) of the Greek Penal Code have been extensively used by the Greek State right after the civil war (1946-1949) against the political dissidents. After the fall of the dictatorship in 1974, they are used less and less.

The special so-called “anti racist” legislation of the late seventies should be regarded as an element of modernization of the Greek penal law, in line with other similar legislative developments aiming at amplifying the antiracist legislative arsenal in Western Europe and combating the anti-Semitic discourse.


3.                       Is there, in any of these provisions, a specific freedom of speech clause? If not, how do these provisions relate to existing (constitutional) legislative provisions concerning freedom of speech?

There is no specific freedom of speech clause in the above mentioned dispositions. Law 1419 has only been applied twice ever since its existence against actions inciting to religious violence, whereas article 192 is rather inactive the last two decades. Case law applying article 192 and punishing perpetrators is generally perceived by the doctrine as a potential threat to the constitutionally enshrined freedom of expression and article 10 of the ECHR.


4.                         Is there in your opinion/according to the leading doctrine a need for additional legislation concerning:

a)         the prohibition of blasphemy or religious insult ?
b)         incitement to religious hatred?
c)         hate speech concerning a group?
d)         speech or publication with a discriminatory effect?
e)         negationism (denial of genocide or other crimes against humanity)?

Although there are conflicting views in the doctrine of penal law, one could generally give “no” as a general answer to the above. Very few scholars advocate the need for additional legislation concerning negationism especially in the light of the procedural and substantial developments regarding the crime of “incitement to genocide” before the International Criminal Court. On the contrary, there is a tendency toward the abolition of the crime of blasphemy advocated by some senior scholars of criminal law and parts of the civil society. 


5.                           Is there any case-law concerning blasphemy, religious insult and/or incitement to religious hatred? If so, are there cases which resulted in the conviction of the perpetrator?

Trials related to the crime of blasphemy are rather frequent in Greece. The most famous among them of them concern spectacles, works of art, films and books which general address the divine in a humiliating way in order to provoke the public’s sacred beliefs. In general terms, these cases become very popular, they create scandals and are followed intensively by the media and the public opinion. However, they are rather exceptional in our days and occur less and less. Such examples are the M. Scorceze’s film “The last temptation”, a novel by M. Androulakis (Μν), Haderer’s comic “The life of Jesus Christ”, a painting by a Belgian painter Tierry de Cordier. On the contrary, the majority of trials against blasphemy remain far from public visibility since they are not related to works of art but to ordinary verbal insults to God, Christ or Madonna, very frequent in the Greek daily life. In these cases, ordinary linguistic forms of modern Greek are used in order to insult a specific individual through insulting his sacred beliefs. Most of these “anonymous” trials lead to the acquittal of the accused.


6.                        What is in such cases the procedural status of the victim(s)?

The ordinary status that the Greek penal procedure accords to any accused individual.


7.                           Did the distinction between “blasphemy”, “religious insult”, “incitement to religious – or racial - hatred”, “defamation” or “discriminatory speech” play a role in the case-law, and was it pertinent to the outcome of the case?

What is the leading opinion in legal doctrine about the current relevance of this distinction?

All cases that have been brought before the Greek judicial authorities for blasphemy (art. 198 an 199 of the Penal Code) concern insults against the Eastern Orthodox Christian religion whereas, as stressed above, the so-called ‘anti-racist’ legislation of 1979 has been applied twice against anti-Semitic speech. Therefore, one could convincingly argue that the distinction in question plays a role in the case-law since there has never been any incident in Greek jurisprudence where the term “blasphemy” was used in order to prescribe insulting acts against any other “tolerable” religion. Additionally, it should not be consider accidental that the use of terms such as “religious insult”, “incitement to religious – or racial - hatred”, “defamation” or “discriminatory speech” is not frequent and, when used, they concern minority religious dogmas rather that the “dominant” religion (the term “dominant” is used in the Greek Constitution). The whole issue has not considerably attracted the attention of the leading opinion of the legal doctrine in the country.


8.                        What role does the intention of the perpetrator and/or the foreseeability of the (discriminatory) effects play in the formulation of the legal prohibition, and/or in the prospect of a conviction?

The Code uses the term “maliciously” in order to put emphasis on the intention of the perpetrator. First instance criminal courts, when condemn perpetrators always refer to their “malicious intention”. However, as it is indicated by the case law and the relevant doctrine, the “intention” is always obscure and therefore hard, not to say impossible, to identify: how can one presume the “malicious” intention of a work of art and prove it in the framework of a judicial procedure?


9.                        Is the prosecution of the suspect of an act of blasphemy, religious insult or incitement to religious hatred at the discretion of the prosecutor?

Yes.


10.                    Is there any superior supervisor? Is there any appeal to a court against non-prosecution?

No.


11.                    Does prosecution of these acts depend on a complaint by the victim(s)?

No, it can equally result from an ex officio investigation carried out by the prosecutor.


12.                     Have there recently been important incidents of alleged blasphemy, religious insult and/or incitement to religious hatred in your country that caused a lot of public indignation and debate but were not prosecuted or not convicted? What was the reason for non-prosecution/non-conviction? What role did freedom of speech play in that case?

As a rule, incidents of alleged blasphemy (cf. answer 5) are sent before the first instance criminal court which regularly punishes the perpetrator, whether this could be the artist, the novelist or the artistic director. Interim measures have equally been imposed in few occasions these last years in order to ban the circulation of a book or forbid a movie. However, it must be noted that the appeal courts have always acquitted the perpetrators in the name of the constitutionally enshrined principles of freedom of speech or freedom of art, offering liberal answers to blasphemy in the Greek jurisprudence. Of course, the acquittal of the accused some months or even a year later cannot do much in order to bring thinks in their previous state of affairs. The censorship damage is already done. As a rule, these cases provoked tensions within the Greek society and attract the interest of electronic media. In such cases, private TV channels always find a good occasion to see their viewing figures rising by triggering of the religious feelings of the public opinion.

On the contrary, an ongoing case of incitement to religious hatred against a novelist of a negationist book (the only such case pending before the Greek judiciary) has not attracted equal interest of the public or the press.


13.                    What is the attitude of the press in relation to such cases? Do they report with restraint in order not to aggravate the effects? Or do they purport to compensate by publicity for the non-prosecution?

The Greek press does not have a uniform position vis-à-vis such cases. One could argue that populist right-wing papers and tabloids always report in order to aggravate the feelings of religious sensitivity of the religious majority whereas, on the contrary, most of the papers report with restraint trying to balance between the two values in cause. A considerable part of the Greek press addresses cases of prosecution of blasphemous acts with indignation against censorship. These last are the only newspapers that also report the few judicial cases of incitement to religious hatred.  In general terms, the reporting problem has more to do with the private TV coverage than the press one, which has proven to be much more responsible.

Denying the Holy Trinity, & on Conviction by Two Witnesses,

Disability or Deprivation of Office; Second Offence,; Disability to sue or to be Guardian, & and Imprisonment for Three Years.

Whereas many Persons have of late Years openly avowed and published many blasphemous and impious Opinions contrary to the Doctrines, and Principles of the Christian Religion greatly tending to the Dishonour of Almighty God and may prove distructive to the Peace and Welfare of this Kingdom Wherefore for the more effectual suppressing of the said detestable Crimes Be it enacted by the Kings most Excellent Majesty by and with the Advice and Consent of the Lords Spiritual and Temporal and the Commons in this present Parliament assembled and by the Authority of the same That if any Person or Persons having been educated in or at any time having made Profession of the Christian Religion within this Realm shal by writing printing teaching or advised speaking deny any one of the Persons in the Holy Trinity to be God or shal assert or maintain there are more Gods than One or shal deny the Christian Religion to be true or the Holy Scriptures of the Old and New Testament to be of Divine Authority and shal upon Indictment or Information in any of His Majesties Courts at Westminster or at the Assizes be thereof lawfully convicted by the Oath of Two or more credible Witnesses such Person or Persons for the First Offence shal be adjudged incapable and disabled in Law to all Intents and Purposes whatsoever to have or enjoy any Office or Offices Imployment or Imploym[en]ts Ecclesiastical Civil or Military or any Part in them or any Profit or Advantage appertaining to them or any of them. And if any Person or Persons so convicted as aforesaid shal at the Time of his or their Conviction enjoy or possess any Office Place or Imployment such Office Place or Imployment shal be voyd and is hereby declared void And if such Person or Persons shall be a Second Time lawfully convicted as aforesaid of all or any the aforesaid Crime or Crimes that then he or they shal from thenceforth be disabled to sue prosecute plead or use any Action or Information in any Court of Law or Equity or to be Guardian of any Child or Executor or Administrator of any Person or capable of any Legacie or Deed of Gift or to bear any Office Civil or Military or Benefice Ecclesiastical for ever within this Realm and shall also suffer Imprisonment for the Space of Three Years without Bail or Mainprize from the Time of such Conviction.

II. No Prosecution except on Information before Justice upon Oath within Four Days.

Provided always and be it enacted by the Authority aforsaid That no Person shall be prosecuted by virtue of this Act for any Words spoken unless the Information of such Words shal be given upon Oath before One or more Justice or Justices of the Peace within Four Days after such Words spoken and the Prosecution of such Offence be within Three Months after such Information.

III. On Renunciation of First Offence discharged of Penalties.

Provided also and be it enacted by the Authority aforesaid That any Person or Persons convicted of all or any of the aforesaid Crime or Crimes in Manner aforesaid shal for the First Offence (upon his her or their Acknowledgement and Renunciation of such Offence or erronious Opinions in the same Court where such Person or Persons was or were convicted as aforesaid within the Space of Four Months after his her or their Conviction) be discharged from all Penalties and Disabilities incurred by such Conviction Any Thing in this Act contained to the contrary thereof in any wise notwithstanding.
