The accusation of stepping on the holy cross:
A medieval Christian invention /

63 [Now there was about this time Jesus, a wise man, if it be lawful to call him a man; for he was a doer of wonderful works, a teacher of such men as receive the truth with pleasure. He drew over to him both many of the Jews and many of the Gentiles. He was [the] Christ.

64 And when Pilate, at the suggestion of the principal men amongst us, had condemned him to the cross, those that loved him at the first did not forsake him; for he appeared to them alive again the third day; as the divine prophets had foretold these and ten thousand other wonderful things concerning him. And the tribe of Christians, so named from him, are not extinct at this day.]

At that time there appeared a man, if it is proper to call him a man, whose nature and form were human but whose appearance was more than human and whose deeds were divine. And he worked wonderful and powerful miracles. Therefore it is impossible for me to call him a man. Then again, in view of his common nature, I shall not call him an angel [either].

And everything, whatever he did, he did by some unseen power, by word and command. Some said of him: Our first lawgiver has risen from the dead and has been demonstrating many cures and skills. Others thought that he was sent from God. But he was in much opposed to the law and did not observe the sabbath according to the ancestral customs, yet did nothing dirty, unclean, nor with use of hands, but worked everything by word only. And many of the people followed and listened to his teachings.

And many souls were aroused, thinking that by him the Jewish tribes would free themselves from the hands of the Romans. But it was his habit rather to remain in front of the city on the Mount of Olives; and there he also [freely] gave cures to people. And there 150 servants and a multitude of people joined him, seeing his power, how by word he did everything he wished. They bade him enter the city, kill the Roman troops and Pilate, and reign over these. But he did not care [to do so].

Later, when news of this came to the Jewish leaders, they assembled to the chief priests and said: We are powerless and [too] weak to oppose the Romans, like a slackened bow. Let us go and inform Pilate what we have heard, and we shall be free of anxiety; if at some time he shall hear [of this] from others, we shall be deprived of property, ourselves slaughtered, and [our] children exiled. And they went and informed Pilate. And he sent and killed many of the people and brought in that wonderworker. After inquiring about him Pilate understood that he was a doer of good, not of evil, [and] not a rebel, nor one desirous of kingship; and he released him. For he had cured his wife, who was dying.

And he went to the usual places and performed his usual deeds. And again, as more people gathered around him, he became renowned for his works more than all [others]. Again the lawyers were struck with envy against him. And they gave 30 talents to Pilate that they should kill him. And he took [it] and gave them liberty to carry out their wishes themselves. And they sought out a suitable time to kill him. For they had given Pilate 30 talents earlier, that he should give Jesus up to them. And they crucified him against the ancestral law, and they greatly reviled him.

The Johannine ‘I am’ sayings
& Yahweh /

Williams goes far beyond the treatments of Jewish texts in previous studies, analyzing also their developed interpretations within Judaism. As a result, the predominant Hebrew scripture rendering of Yahweh’s ánî hû pronouncements should be ‘I am he’ rather than ‘I am’. In showing the extensive ways in which Yahweh’s assurances of provision for Israel are associated with his self declarations, Williams argues that the I-am sayings in Mark and in John are connected not to the theophany of Yahweh before Moses and the burning bush (Exod. 3.14), but with Yahweh’s assurances of guidance and provision for Israel elsewhere. The significance of Williams’ contribution is that it clarifies the prevalent I-am claims of Yahweh in scripture, connecting the saving action of Yahweh—rather than his divine being—with Jesus’ I-am sayings in John.

F. J. A. Hort & the Byzantine NT text /

B. F. Westcott & F. J. A. Hort,
The Greek New Testament
, *
Hendrickson Publishers 2007,
p./σ. xv.
[Ελληνικά-Αγγλικά/Greek-English, PDF]

Incidentally, in a letter penned by Hort in 1851 when he was only twenty-three years of age, he provided a forecast of the future by referring to the "villainous" and "vile" textus receptus "leaning entirely on late MSS; it is a blessing there are such early ones." Just two years later, after Westcott and he had planned their [i.e. NT] edition, Hort wrote, "Our object is to supply . . . a portable Gk. Test[ament], which shall not be disfigured with Byzantine corruptions."

Religion in Russia
after the revolution of 1917 /

Religion, as a community of faith, is able to forge boundaries of selective inclusion and of exclusion. In the examined case of the Russian Orthodox Church (ROC), this was reflected in the Church’s efforts to discredit Western spiritual values and its way of life as „immoral”. In the context of Russia one has to also underline, in addition to its inherited Eastern Church’s hostility to Rome and the West, the consequences of Russia’s isolation from Renaissance and Reformation. Thus, on the top of the modernization barriers separating Russia from the West, it may also be necessary to consider the historical borders.

A unique characteristic of Russian Orthodoxy is that after the 1917 Bolshevik revolution in Russia its theological, sacramental, and ecclesiastical development was frozen, resulting in a long spiritual and intellectual hibernation. While the religious denominations in the West were embracing the ideas of individual liberty and human rights, and while Catholicism was absorbing the consequences of the Second Vatican Council, the Moscow Metropolitanate was working hand in hand with the Soviet Politburo and KGB, both domestically and internationally. [...]

Orthodox Church had and continues to have a key influence on the nature of political development in Russia. It contradicts the volume of research claiming that Eastern Orthodoxy is favoring democratic development, pointing out to its failure to examine the Church as a social rational actor, instead of a philosophical concept. Cherry-picking specific points or events in time and claiming they prove the democratic character of ROC is a sure recipe for analytic errors. This static method is replaced in the current study by a dynamic approach, which examines the historical interaction between state and church over time, the effects it generated, and the interests behind the actions of the two actors in post-Soviet Russia.

[...] This initial separation in the West, followed by later separations inside Catholic Church itself, created a number of powerful actors, who through competition generated profound social transformations. Building on the literature on democratization and agent based modeling research  on cultural diffusion it claimed that independent and competing actors are able to generate and sustain multiple loyalties and pluralism. This was not the case in Russia, where Church and State merged into a single power center, failing to generate social transformations in the society similar the West.

The historical legacy of the Orthodox Church affected its institutional structure, its modus operandi, and most importantly, the worldviews of its top prelates. Formal modeling research of cultural behavior seems to confirm the claim that cognitive constraints and institutional precedents are a better explanation of community behavior, be it cultural-religious or political. It shows that institutions will often follow a sub-optimal behavior, choosing strategies that performed well in the past, even though they occurred under differing conditions. Thus, after the collapse of USSR, ROC did not choose a path of independence from the State, as it did not possess an institutional memory and knowledge of such a choice having been successful in the past.

P. Boumis on Acts 20:28:
Whose blood? /

Τίνος το αίμα;

G. C. Knapp, Novum Testamentum Graece (1824),
Sylloge conjecturar.
"Primitively perhaps it was thus written:
'the church, which he [God, v. 27]
purchased with the blood
of his own [namely, Son].' Rom. 8:3, 32."

The freedom of conscience
interpreted by the Law:
The contribution
of the Efstratiou & Valsamis v. Greece cases /

As we will see, in both cases, the effect of those lines of decision is the unequal treatment of people with religious convictions in comparison with people with non-religious convictions, and of religious minorities in comparison with religious majorities. The former occurs when the public space is designed in such a way that it fulfils completely the aspirations of atheists or agnostics, or simply of people that do not care much about the expression of their religious ideas, but does not correspond to the expectations of religious believers who remain actively engaged with their respective religions. The latter occurs because the laws considered ‘neutral’ usually conform—as does any law—to the ethical values that are dominant in a determined social environment at a certain moment. Neutral laws will rarely conflict with the morals or life practices of the major churches, but they can more often cause conflicts with minority religious groups that engage in conduct that is socially atypical. To hold that a neutral law must automatically prevail and that the state is under no obligation to justify denial of exemptions from the general application of the law as a measure ‘necessary in a democratic society’ would constitute, in practice, a risk for the rights of minorities, and generally for those whose conscientious beliefs are threatened. [...]

In any event, more than thirty years later, the ECtHR’s interpretation of Article 2 of the First Protocol was reaffirmed in the decisions Folgerø and Zengin. And, prior to them, in 1996, the twin decisions Efstratiou and Valsamis, dealing with a relatively similar problem, held on to the Court’s doctrine on the automatic subjection to neutral rules. These cases had their origin in the applications of two Greek secondary school students, both Jehovah’s Witnesses, who refused, for religious reasons, to participate in the school parades organized during the national festival to commemorate the outbreak of war between Greece and Fascist Italy in 1940. They argued that their conscience prohibited them from being present in a civic celebration in which a war was remembered and in which military and ecclesiastical authorities took part. The two students were denied permission to be absent from the parade, and their failure to attend was punished by one day’s suspension from school. The European Court decided the case in the light both of Article 9 of the Convention and of Article 2 of the First Protocol (as interpreted in Kjeldsen). The decision sustained the Greek government’s position, especially considering two facts. One was the moderate punishment imposed to the students, which could not amount to a deprivation of the right to education. The other was that the Court could ‘discern nothing, either in the purpose of the parade or in the arrangements for it, which could offend the applicants’ pacifist convictions’. The Court noted additionally—without any further comment—that the European Commission considered, in its report on the case, that ‘article 9 did not confer a right to exemption from disciplinary rules which applied generally and in a neutral manner and that, in the instant case, there had been no interference with the applicant’s right to freedom to manifest her religion or belief ’.

In my opinion, the Commission’s interpretation of Article 9 ECHR inverts the logical order of concepts in this matter. It is universally accepted that human rights must be construed broadly. Therefore, in order to understand the exact meaning of the freedom to manifest one’s religion or belief in practice, it seems that we should approach the question in the following sequence: (i) according to Article 9.1 ECHR, freedom to practice one’s religion or belief must be understood as protecting, in principle, every act of the individual when he obeys the dictates of his own conscience; but (ii) Article 9.2 ECHR—limitations on religious liberty—shall be utilized, when necessary, as a corrective element for a freedom that, by its own nature, tends to be exercised in an undefined and unpredictable way.

Thus, we manage to reconcile two paramount interests that are inclined to conflict with each other: the maximum degree of initial protection of the freedom of belief and the security that the legal order demands. Furthermore, we introduce an important assumption: the State has the burden of proof with regard to the necessity of a restrictive measure, ie, it must affirmatively prove that, in a particular case of conflict, it is ‘necessary in a democratic society’ to restrict the exercise of religious freedom. Following this approach would obstruct the development of policies that ignore the needs of religious freedom and are harmful not only to individuals but also to minority groups and, in general, to groups with distinctive beliefs.

In any event, it should be remarked that the Court neither subscribed to nor rejected explicitly the Commission’s interpretation of Article 9 ECHR in Efstratiou and Valsamis. The Commission’s view might be expressive of a certain state of mind in the Strasbourg jurisdiction, in a line of continuity with Kjeldsen. However, we might as well infer from other decisions that the Court is hesitating about which path it should follow beyond the strict borders of the educational environment. In this regard, we should remember that the Commission’s restrictive interpretation of freedom of conscience seems to contradict the Court’s own words in the Hasan and Chaush case: ‘[. . .] but for very exceptional cases, the right to freedom of religion as guaranteed under the Convention excludes any discretion on the part of the State to determine whether religious beliefs or the means used to express such beliefs are legitimate.’ And, certainly, behaviour in accordance with the dictates of one’s own conscience in daily life is an evident, and most important, expression of freedom of religion and belief.

There is another aspect in the ECtHR’s reasoning in Efstratiou and Valsamis that is problematic and not easy to reconcile with State neutrality in religious matters. When the Court examined the arguments of the applicants, it declared that the parades that the Jehovah’s Witnesses morally disapproved of were merely civic acts without any particular political or ideological connotation and, consequently, they could not offend the pacifist convictions of the students. Thus, the Court, in effect, substituted its judgment for the conscience of the persons involved, defining what was ‘reasonable’ for them to believe with regard to their participation in a national commemorative ceremony. In my opinion, this is a gross mistake. In assessing claims arising from individual conscience, it is unacceptable for a secular court to determine which beliefs are ‘reasonable’ and which are not. Naturally, it is necessary to verify—as far as possible—that parties are sincere, that they are not deceitfully alleging moral convictions they do not actually or genuinely hold in order to avoid fulfilling a legal duty. But this does not mean that a secular court is competent to elucidate when the beliefs of a person are sufficiently consistent from an ‘objective’ point of view. Religious viewpoints do not need to meet a reasonableness threshold in order to qualify as a basis for asserting Article 9 rights. This is in contradiction with what the ECtHR affirmed, the very same year of Efstratiou and Valsamis, reflecting a deeply rooted notion of Western legal culture, about the incompetence of public authorities to pronounce on the truth or falsity of a religious dogma or a moral belief. In the above-mentioned decisions, the European Court did not seem to be fully aware of the fundamental philosophy underlying the protection of religious liberty. The reason why the freedom of each individual conscience must be respected is not that it is objectively correct. Freedom of conscience must be respected because it is considered a fundamental area of the individual’s autonomy in democratic societies and, consequently, nobody may interfere with the individual’s conscience as long as other prevailing juridical interests are not endangered. This applies also to those cases in which the moral position held by individuals is stricter than the official doctrine of the religion to which they belong. What freedom of religion or belief protects is, precisely, the right to choose the truth(s) in which one is willing to believe. Hence, Article 9.2 ECHR provides that the state may restrict the exercise of that freedom only when it is ‘necessary in a democratic society’.

In other words, States are not obliged to respect and protect religious freedom because they deem the convictions of their citizens to be correct, or even convenient. They are obliged to protect the freedom to believe and to act accordingly because this freedom constitutes an essential element of a democratic system. The protection of that freedom is a paramount public interest and not merely a private interest of individuals and groups. This is something that is easily understood with regard to other liberties—for instance, the freedom of expression or the freedom of association—but is sometimes inexplicably ignored when dealing with religious liberty.

Early Christians
& the pagan world /

The Kokkinakis v Greece case:
Defining pluralism and majoritarianism

The ECtHR is, however, not in the role of bystander in the name of the principled compatibility between the Convention and the diversity of the European state-religion models. Though a margin of appreciation is left to national authorities, their decision remains subject to review by the Court in conformity with the requirements of the Convention and Protocols. The Court has, in its reviewing competence, attempted to develop a ”thin” constitutional framework (or perspective) whereby it sets specific limitations to the margin of appreciation of the national authorities. With respect to religion, this trend gained momentum with Kokkinakis v Greece (1993). Kokkinakis has the merit of being the first case to be judged under article 9 of the Convention, which states the principle of freedom of religion: “[e]veryone has the right to freedom of ... religion; this right includes ... freedom, either alone or in community with others and in public or private, to manifest his religion ... in worship, teaching, practice and observance.” Even if the concept of pluralism is an older presence in the jurisprudence of the Court, Kokkinakis has the merit to have interconnected, in a decisive way, the principle of freedom of religion with that of pluralism as an essential feature of the democratic society. According to Kokkinakis, “[a]s enshrined in Article 9…, freedom of thought, conscience and religion is one of the foundations of a´ democratic society within the meaning of the Convention. It is, in its religious dimension, one of the most vital elements that go to make up the identity of believers and their conception of life, but it is also a precious asset for atheists, agnostics, skeptics and the unconcerned. The pluralism indissociable from a democratic society, which has been dearly won over the centuries, depends on it.” The corollary of the Court´s support of the liberal-pluralist perspective has been its questioning of biased aspects of the inherited bond between majority religion and nation-state. It is significant that Kokkinakis v Greece defended Mr. Kokkinakis´ freedom of speech against the manifest bias of the Greek state in favor of the majority religion (i.e. Orthodox Christianity). It is certainly disconcerting to learn that the appellant, a member of the religious minority of Jehovah’s Witnesses, had been arrested more than sixty times before his case reached the ECtHR.

Friedrich Engels
on the medieval European
state of the Church /

The clergy, representatives of the ideology of mediaeval feudalism, felt the influence of the historic transformation no less acutely. The invention of the art of printing, and the requirements of extended commerce, robbed the clergy not only of its monopoly of reading and writing, but also of that of higher education. Division of labour was being introduced also into the realm of intellectual work. The newly arising class of jurists drove the clergy out of a series of very influential positions. The clergy was also beginning to become largely superfluous, and it acknowledged this fact by growing lazier and more ignorant. The more superfluous it became, the more it grew in numbers, thanks to the enormous riches which it still kept on augmenting by fair means or foul.

The clergy was divided into two distinct groups. The feudal hierarchy of the clergy formed the aristocratic group — bishops and archbishops, abbots, priors and other prelates. These high church dignitaries were either imperial princes themselves, or they reigned as vassals of other princes over large areas with numerous serfs and bondsmen. They not only exploited their subjects as recklessly as the knighthood and the princes, but they practised this in an even more shameful manner. They used not only brutal force, but all the intrigues of religion as well; not only the horrors of the rack, but also the horror of excommunication, or refusal of absolution; they used all the intricacies of the confessional in order to extract from their subjects the last penny, or to increase the estates of the church. Forging of documents was a widespread and beloved means of extortion in the hands of those worthy men, who, receiving from their subjects feudal payments, taxes and tithes, were still in constant need of money. The manufacture of miracle-producing saints' effigies and relics, the organisation of praying-centres endowed with the power of salvation, the trade in indulgences was resorted to in order to squeeze more payments out of the people. All this was practised long and with not little success.

The prelates and their numerous gendarmerie of monks which grew with the spread of political and religious baiting, were the objects of hatred not only of the people but also of the nobility. Being directly under the empire, the prelates were in the way of the princes. The fast living of the corpulent bishops and abbots with their army of monks, roused the envy of the nobility and the indignation of the people who bore the burden. Hatred was intensified by the fact that the behaviour of the clergy was a slap in the face of their own preaching.

The plebeian faction of the clergy consisted of preachers, rural and urban. The preachers were outside the feudal hierarchy of the church and participated in none of its riches. Their activities were less rigorously controlled and, important as they were for the church, they were for the moment far less indispensable than the police services of the barracked monks. Consequently, they were paid much less than the monks, and their prebends were far from lucrative. Being of a middle-class or plebeian origin, they were nearer to the life of the masses, thus being able to retain middle-class and plebeian sympathies, in spite of their status as clergy. While the participation of the monks in the movements of their time was the exception, that of the plebeian clergy was the rule. They gave the movement its theorists and ideologists, and many of them, representatives of the plebeians and peasants, died on the scaffold. The hatred of the masses for the clergy seldom touched this group.

What the emperor was to the princes and nobility, the pope was to the higher and lower clergy. As the emperor received the "common penny," the imperial taxes, so the pope was paid the general church taxes, out of which he defrayed the expenses of the luxurious Roman court. In no country were his taxes collected with such conscientiousness and rigour as in Germany, due to the power and the number of the clergy. The annates were collected with particular severity when a bishopric was to become vacant. With the growth of the court's demands, new means for raising revenues were invented, such as the traffic in relics and indulgences, jubilee collections, etc. large sums of money were thus yearly transported from Germany to Rome, and the increased pressure fanned not only the hatred towards the clergy, but it also aroused national feelings, particularly among the nobility, the then most national class.
